98STATEMENT OF THE ISSUE

102Whether Respondent violated the Florida Civil Rights Act of

1111992, as alleged in the Charge of Discrimination filed by

121Petitioner on March 10, 2004.

126PRELIMINARY STATEMENT

128On March 10, 2004, Petitioner, Douglas Randall, filed a

137Charge of Discrimination with the Florida Commission on Human

146Relations (FCHR), which alleged that Sacred Heart Hospital

154violated Section 760.10, Florida Statutes (2004), by

161discriminating against him on the basis of race and for

171retaliation. The Charge of Discrimination alleged that he was

180given a written reprimand which prevented him from transferring

189positions, was given an unfair evaluation, and was placed on

199probation after complaining about disparate treatment.

205The allegations were investigated, and on February 16,

2132005, FCHR issued its determination of No Cause and Notice of

224Determination: No Cause.

227A Petition for Relief was filed by Petitioner on March 16,

2382005. In the Petition for Relief, Petitioner stated that he

248never complained about race and that race was never an issue but

260retaliation was. FCHR transmitted the case to the Division of

270Administrative Hearings on or about March 18, 2005. A Notice of

281Hearing was issued setting the case for formal hearing on

291May 23, 2005.

294At hearing, Petitioner testified on his own behalf.

302Petitioner offered Exhibits numbered 1 through 4. Exhibits 1

311and 4 were admitted into evidence. Exhibits 2 and 3 were

322rejected. Respondent did not present any witnesses or offer any

332additional exhibits but did cross-examine Petitioner.

338A Transcript, consisting of one volume, was filed on

347June 6, 2005. Respondent timely filed a Proposed Recommended

356Order which has been considered in the preparation of this

366Recommended Order. 1/ Petitioner did not file a post-hearing

375submission.

376All references to Florida Statutes is to 2004 unless

385otherwise indicated.

387FINDINGS OF FACT

3901. Petitioner is an African-American man who was employed

399by Respondent from May 2003, until July 29, 2004.

4082. Respondent, Sacred Heart Health Systems, operates a

416charitable, not for profit acute care hospital in Pensacola

425called Sacred Heart Hospital.

4293. While employed at Sacred Heart Hospital, Petitioner was

438a call center resource agent. His supervisor was Jane Nix.

4484. During cross-examination, Petitioner responded as

454follows when asked whether Respondent had discriminated against

462him on the basis of race:

468Q: And is it fair to say that you truly

478believe that Sacred Heart did not

484discriminate against you because of your

490race at any time during your employment?

497A: Yes, it is.

501Q: And is it also true that Ms. Nicks [sic]

511did not discriminate against you because of

518your race at any time during your employment

526at Sacred Heart Hospital?

530A: No, sir, she did not.

536Q: Okay. Your race was never an issue at

545any time during your employment at Sacred

552Heart Hospital?

554A: Not to my knowledge, no sir.

561Q: You also never complained of

567discrimination based on race at any time

574during your employment at Sacred Heart

580Hospital; is that correct?

584A: This is correct.

588Q: And no one at Sacred Heart ever

596retaliated against you because of your race?

603A: Not because of race, no sir.

610Q: And you know this because you would not

619allow anybody to discriminate against you

625because of your race; is that correct?

632A: This is correct.

636Q: Or retaliate against you because of your

644race?

645A: This is correct.

649Q: And you do not believe that Sacred Heart

658violated the Florida Civil Rights Act; is

665that correct?

667A: No, sir, I do not.

673Q: And you do not believe that Sacred Heart

682violated the Florida Civil Rights Act; is

689that correct?

691A: No, sir, I do not.

697Q: And you do not believe that Ms. Nicks

706(sic) violated the Florida Civil Rights Act;

713is that correct?

716A: No sir, I do not.

7225. By his own admission, Petitioner does not allege

731discrimination or retaliation by Respondent on the basis of

740race.

741CONCLUSIONS OF LAW

7446 . Section 760.10(1), Florida Statutes, states that it is

754an unlawful employment practice for an employer to discharge or

764otherwise discriminate against an individual on the basis of

773race.

7747. Because there are no allegations that Respondent

782violated the Florida Civil Rights Act, there has been no unlawful

793employment practice committed as contemplated by Section 760.10,

801Florida Statutes.

8038. Accordingly, the Florida Commission on Human Relations

811has no jurisdiction over this matter.

817RECOMMENDATION

818Based upon the foregoing Findings of Fact and Conclusions

827of Law set forth herein, it is

834RECOMMENDED:

835That the Florida Commission on Human Relations enter a

844final order dismissing the Petition for Relief for lack of

854jurisdiction.
