38This matter came on for consideration on January 25, 2008,
48without hearing, on Respondent, Department of Children and
56Family Services' Motion to Dismiss First Amended Petition.
64Having considered Respondent's motion, Petitioner's Response in
71Opposition and Motion to Strike Respondent Department of
79Children and Families' Motion to Dismiss First Amended
87Complaint, and being otherwise fully advised,
93The following Findings of Fact are made:
1001. Respondent, pursuant to Section 394.9151, Florida
107Statutes (2007), has contracted with private entities, The GEO
116Group, Inc., and GEO Care, Inc. ("GEO"), to use and operate a
130facility, Florida Civil Commitment Center, to comply with the
139requirements of Chapter 395, Part V, Florida Statutes (2007)
148(entitled "Involuntary Civil Commitment of Sexually Violent
155Predators").
1572. Petitioner, James R. Demick, is a person subject to
167Chapter 395, Part V, Florida Statutes (2007), and is confined in
178the Florida Civil Commitment Center.
1833. Petitioner has filed a First Amended Petition of
192Unpromulgated Rule Challenge as an Improper Exercise of
200Delegated Legislative Authority in which he seeks a
208determination that certain internal memoranda and policies of
216GEO, including Policy No. F-24, the FCCC Resident Handbook, and
226the C.A.R.E. Program, that are "imposed on Florida Civil
235Commitment Center residents, are an improper exercise of
243delegated legislative authority as de facto agency rules that
252have not been adopted under proper rule making procedures of
262section 120.54(1)(a)."
2644. Subsection 120.52(1), Florida Statutes (2007), defines
"271Agency" as:
273(a) The Governor in the exercise of all
281executive powers other than those derived
287from the constitution.
290(b) Each:
2921. State officer and state department,
298and each departmental unit described in s.
30520.04.
3062. Authority, including a regional water
312supply authority.
3143. Board, including the Board of
320Governors of the State University System and
327a state university board of trustees when
334acting pursuant to statutory authority
339derived from the Legislature.
3434. Commission, including the Commission
348on Ethics and the Fish and Wildlife
355Conservation Commission when acting pursuant
360to statutory authority derived from the
366Legislature.
3675. Regional planning agency.
3716. Multicounty special district with a
377majority of its governing board comprised of
384nonelected persons.
3867. Educational units.
3898. Entity described in chapters 163, 373,
396380, and 582 and s. 186.504.
402(c) Each other unit of government in the
410state, including counties and
414municipalities, to the extent they are
420expressly made subject to this act by
427general or special law or existing judicial
434decisions.
435This definition does not include any legal
442entity or agency created in whole or in part
451pursuant to chapter 361, part II, any
458metropolitan planning organization created
462pursuant to s. 339.175, any separate legal
469or administrative entity created pursuant to
475s. 339.175 of which a metropolitan planning
482organization is a member, an expressway
488authority pursuant to chapter 348 or
494transportation authority under chapter 349,
499any legal or administrative entity created
505by an interlocal agreement pursuant to
511s. 163.01(7), unless any party to such
518agreement is otherwise an agency as defined
525in this subsection, or any multicounty
531special district with a majority of its
538governing board comprised of elected
543persons; however, this definition shall
548include a regional water supply authority.
5545. Subsection 120.52(15), Florida Statutes (2007), in
561pertinent part, defines "Rule" as:
566(15) "Rule" means each agency statement of
573general applicability that implements,
577interprets, or prescribes law or policy or
584describes the procedure or practice
589requirements of an agency and includes any
596form which imposes any requirement or
602solicits any information not specifically
607required by statute or by an existing rule.
615The term also includes the amendment or
622repeal of a rule. (Emphasis added.)
6286. Subsections 120.56(1)(a) and (4)(a), Florida Statutes
635(2007), read, in pertinent part:
640(1)(a) Any person substantially affected by
646a rule or a proposed rule may seek an
655administrative determination of the
659invalidity of the rule on the ground that
667the rule is an invalid exercise of delegated
675legislative authority.
677* * *
680(4)(a) Any person substantially affected by
686an agency statement may seek an
692administrative determination that the
696statement violates s. 120(1)(a). (Emphasis
701added.)
7027. Section 394.930, Florida Statutes (2007), reads, as
710follows:
711The Department of Children and Family
717Services shall adopt rules for:
722(1) Procedures that must be followed by
729members of the multidisciplinary teams when
735assessing and evaluating persons subject to
741this part;
743(2) Education and training requirements
748for members of the multidisciplinary teams
754and professionals who assess and evaluate
760persons under this part;
764(3) The criteria that must exist in order
772for a multidisciplinary team to recommend to
779a state attorney that a petition should be
787filed to involuntarily commit a person under
794this part. The criteria shall include, but
801are not limited to, whether:
806(a) The person has a propensity to engage
814in future acts of sexual violence;
820(b) The person should be placed in a
828secure, residential facility; and
832(c) The person needs long-term treatment
838and care.
840(4) The designation of secure facilities
846for sexually violent predators who are
852subject to involuntary commitment under this
858part;
859(5) The components of the basic treatment
866plan for all committed persons under this
873part;
874(6) The protocol to inform a person that
882he or she is being examined to determine
890whether he or she is a sexually violent
898predator under this part.
902Based on the foregoing, the following Conclusions of Law
911are made:
9138. GEO is not an "agency" as defined in Subsection
923120.52(1), Florida Statutes (2007). Florida Department of
930Insurance v. Florida Association of Insurance Agents , 813 So. 2d
940981 (Fla. 1st DCA 2002); Department of Corrections v. Adams ,
950458 So. 2d 354 (Fla. 1st DCA 1984).
9589. The internal memoranda and policies of GEO, including
967Policy No. F-24, the FCCC Resident Handbook, and the C.A.R.E.
977Program, are not agency rules as defined by Subsection
986120.52(15), Florida Statutes, and are not subject to challenge
995pursuant to Subsection 120.56(4), Florida Statutes.
100110. The rule making authority extended to Respondent in
1010Section 394.930, Florida Statutes (2007), does not extend to the
1020internal memoranda and policies of a private contractor as
1029authorized by Section 394.9151, Florida Statutes.
1035It is, therefore,
1038ORDERED that the Division of Administrative Hearings lacks
1046jurisdiction to consider the internal operating policies of GEO
1055as defined and challenged in Petitioner's First Amended
1063Petition; therefore, the First Amended Petition is dismissed
1071with prejudice.
