115PRELIMINARY STATEMENT

117Because of the procedural nature of the findings in this

127case, the matters normally contained in the Preliminary

135Statement are reflected in the Findings of fact below.

144FINDINGS OF FACT

1471. On February 5, 2007, Petitioner, Cynthia D. Smith,

156filed an Employment Complaint of Discrimination with the Florida

165Commission on Human Relations (FCHR). On September 6, 2007,

174FCHR issued a Determination: No Cause and a Notice of

184Determination: No Cause. Petitioner filed a Petition for

192Relief with FCHR on or about September 17, 2007.

2012. FCHR transmitted the case to the Division of

210Administrative Hearings (Division) on or about September 19,

2182007, for the purpose of conducting a formal administrative

227hearing. A Notice of Hearing and Order of Pre-Hearing

236Instructions were issued on October 16, 2007, setting the case

246for hearing on December 18, 2007, in Leesburg, Florida, where

256Petitioner resides.

2583. Respondent filed an unopposed Motion for Continuance

266which was granted. An Order Granting Continuance and Re-

275Scheduling Hearing was issued on December 3, 2007, rescheduling

284the hearing for January 10, 2007, in Leesburg.

2924. The undersigned traveled from Tallahassee to Leesburg,

300Florida, to conduct the hearing. The hearing commenced as

309scheduled. Respondent and its witnesses were present and ready

318to proceed. Petitioner was not present when the hearing

327commenced.

3285. The undersigned recessed the hearing to give Petitioner

337every opportunity to arrive. The undersigned checked the

345reception area and the parking lot of the building where the

356hearing was located to see if Petitioner was anywhere in or

367around the building. In addition, the undersigned called her

376assistant in Tallahassee to determine if any pleading had been

386filed on the docket of the Division or any telephone call

397received indicating Petitioner was delayed. No such

404communication had been received.

4086. While waiting for Petitioner to arrive, the undersigned

417examined the address for Petitioner on the Order Granting

426Continuance and Re-Scheduling Hearing. The address matched the

434address on all orders mailed from the Division as well as the

446address furnished by FCHR to the Division.

4537. The hearing was reconvened approximately 35 minutes

461after the time the hearing was scheduled to begin. However,

471Petitioner did not appear and the hearing was adjourned.

4808. There is nothing on the docket of the Division that

491indicates that the Order Granting Continuance and Re-Scheduling

499Hearing, or any other order, mailed to Petitioner was returned

509as undeliverable. 1/

512CONCLUSIONS OF LAW

5159. The Division of Administrative Hearings has

522jurisdiction over the parties and subject matter of this

531proceeding. §§ 120.569, 120.57, and 760.11, Fla. Stat.

53910. Petitioner bears the initial burden of proving a prima

549facie case of discrimination. McDonnell Douglas Corp. v. Green ,

558411 U.S. 792 (1973); Texas Department of Community Affairs v.

568Burdine , 450 U.S. 248 (1981). Since Petitioner did not avail

578herself of the opportunity to present a prima facie case, the

589hearing was closed.

592RECOMMENDATION

593Based upon the foregoing Findings of Fact and the

602Conclusions of Law, it is

607RECOMMENDED:

608That the Florida Commission on Human Relations enter a

617final order dismissing Petitioner's Employment Complaint of

624Discrimination.
