90STATEMENT OF THE ISSUE

94The issue is whether Petitioners should be permitted to

103establish an additional dealership for the sale of motorcycles

112manufactured by Astronautical Bashan Motorcycle Manufacturer

118Company, Ltd., at 5720 North Florida Avenue, Tampa, Florida.

127PRELIMINARY STATEMENT

129On March 7, 2008, a notice was published in the Florida

140Administrative Weekly that pursuant to Section 320.642, Florida

148Statutes (2007), 1 Petitioner, Peace Industry Group, Inc. ("Peace

158Industry"), intended "to allow the establishment of [Petitioner]

167Mobility Tech, Inc. ["Mobility Tech"], as a dealership for the

179sale of motorcycles manufactured by Astronautical Bashan

186Motorcycle Manufacture Company, Ltd. (BASH), at 5720 North

194Florida Avenue, Tampa (Hillsborough County), Florida

20033604. . . ." On March 31, 2008, Respondent, Discount Scooters,

211Inc. ("Respondent"), filed with the Department of Highway Safety

222and Motor Vehicles ("Department") a "petition or complaint"

232protesting the establishment of the additional dealership at the

241proposed location. The matter was referred to the Division of

251Administrative Hearings on April 3, 2008, to conduct the final

261hearing.

262This final hearing was scheduled for October 7, 2008.

271Petitioners and Respondent were provided with written notice in

280accordance with Subsection 120.569(2)(b), Florida Statutes. The

287notice, in the form of a Notice of Hearing, was mailed on

299May 27, 2008, to Petitioners and to Respondent at their

309respective addresses of record.

313As noted above, the final hearing in the case was held, as

325noticed, on October 7, 2008. Despite the undersigned's waiting

334about an hour to convene the hearing, Petitioners did not appear

345to present their case. Respondent appeared at hearing through

354its representative, Brooke S. Gentile.

359Respondent presented the testimony of Brooke S. Gentile,

367owner of Discount Scooters, Inc., and offered and had four

377exhibits received into evidence.

381The proceeding was recorded, but was not transcribed.

389Neither of the parties submitted proposed recommended orders.

397FINDINGS OF FACT

400Based on the evidence adduced at hearing and the record as

411a whole, the following Findings of Fact are made:

4201. On March 7, 2008, the Florida Administrative Weekly

429published a notice that Peace Industry Group intended to allow

439the establishment of Mobility Tech as a dealership for the sale

450of motorcycles manufactured by BASH at 5720 North Florida Avenue

460in Tampa (Hillsborough County), Florida. The notice also stated

469that the "new point" location for the proposed dealership is in

480a "county of more than 300,000 population, according to the

491latest population estimates of the University of Florida, Bureau

500of Economic and Business Research."

5052. Respondent is an existing franchised dealer of

513motorcycles manufactured by BASH.

5173. Respondent's dealership is located at 5908 North

525Armenia Avenue in Tampa, Florida.

5304. The driving distance between Respondent's dealership

537and the location of the new dealership that Peace Industry

547proposes to establish is 2.05 miles.

553CONCLUSIONS OF LAW

5565. The Division of Administrative Hearings has

563jurisdiction of the subject matter of and the parties to this

574proceeding. §§ 120.569 and 120.57(1), Fla. Stat. (2008).

5826. The Department is the agency responsible for regulating

591the licensing and franchising of motor vehicle dealers.

599§ 320.60 through 320.70, Fla. Stat.

6057. Peace Industry Group and Mobility Tech are seeking the

615Department's approval of a proposal to establish a new

624dealership for the sale of motorcycles manufactured by BASH at

6345720 North Florida Avenue in Tampa, Florida, pursuant to Section

644320.642, Florida Statutes.

6478. Subsection 320.642(1), Florida Statutes, requires a

654motor vehicle dealer who proposes to establish an additional

663motor vehicle dealership within an area already represented by

672the same line-make vehicle to give written notice to the

682Department of its intent. The Department is then required to

692publish the notice in the Florida Administrative Weekly.

700§ 320.642, Fla. Stat.

7049. Subsection 320.642(2)(a), Florida Statutes, provides

710that approval of a motor vehicle dealer's proposal to establish

720an additional dealership within an area where the same line-make

730dealer is represented shall be denied if:

7371. A timely protest is filed by a

745presently existing franchised motor vehicle

750dealer with standing to protest as defined

757in subsection (3); and

7612. The licensee fails to show that the

769existing franchised dealer or dealers who

775register new motor vehicle retail sales or

782retail leases of the same line-make in the

790community or territory of the proposed

796dealership are not providing adequate

801representation of such line-make motor

806vehicles in such community or territory.

812The burden of proof in establishing

818inadequate representation shall be on the

824licensee.

82510. Subsection 320.642(3), Florida Statutes, sets forth

832the requirements an existing franchised motor vehicle dealer

840must meet in order to have standing to protest a proposed

851additional dealership. That section provides in pertinent part:

859(3) An existing franchised motor vehicle

865dealer or dealers shall have standing to

872protest a proposed additional or relocated

878motor vehicle dealer where the existing

884motor vehicle dealer or dealers have a

891franchise agreement for the same line-make

897vehicle to be sold or serviced by the

905proposed additional or relocated motor

910vehicle dealer and are physically located so

917as to meet or satisfy any of the following

926requirements or conditions:

929* * *

932(b) If the proposed additional or

938relocated motor vehicle dealer is to be

945located in a county with a population of

953more than 300,000 according to the most

961recent data of the United States Census

968Bureau or the data of the Bureau of Economic

977and Business Research of the University of

984Florida:

9851. Any existing motor vehicle dealer or

992dealers of the same line-make have a

999licensed franchise location within a radius

1005of 12.5 miles of the location of the

1013proposed additional or relocated motor

1018vehicle dealer; or . . . .

102511. In this case, the evidence established that Respondent

1034is an existing motor vehicle dealer which has a franchise

1044agreement for the same line-make vehicle to be sold by the

1055proposed additional motor vehicle dealer. The record also

1063established that the proposed additional motor vehicle dealer is

1072to be located in a county with a population of more than 300,000

1086according to the most recent data of the Bureau of Economic

1097Research of the University of Florida. Finally, the evidence

1106established that Respondent, the existing dealership, has a

1114licensed franchise location within a radius of 12.5 miles of the

1125location of the proposed additional motor vehicle dealer.

113312. For the reasons stated in paragraph 11, Respondent has

1143standing to file a protest in this case.

115113. Where, as in this case, Respondent filed a protest and

1162established that it has standing to do so, Petitioners, as

1172licensees, must meet the burden of proof enunciated in

1181Subsection 320.642(2)(a)2., Florida Statutes. According to that

1188provision, Respondent must establish that the existing

1195franchised dealer is not providing adequate representation of

1203the line-make motor vehicles in the subject territory.

121114. In this case, Petitioners, as licensees, failed to

1220appear at the hearing after proper notice of the hearing was

1231issued. Thus, no evidence was presented to establish that

1240Respondent was not providing adequate representation of the

1248line-make motor vehicles in the territory in which the proposed

1258dealership intends to locate. Absent such evidence, Petitioners

1266failed to meet their burden of proof.

127315. Having failed to meet their burden of proof, the

1283RECOMMENDATION

1284Based on the foregoing Findings of Fact and Conclusions of

1294Law, it is

1297RECOMMENDED that the Department of Highway Safety and Motor

1306Vehicles issue a final order denying Petitioners, Peace Industry

1315Group, Inc., and Mobility Tech, Inc.'s, approval to establish a

1325new BASH motorcycle dealership at 5720 North Florida Avenue,

1334Tampa, Florida.
