106STATEMENT OF THE ISSUE
110The issue is whether Petitioner is eligible to purchase
119continuous coverage of health insurance pursuant to the
127Consolidated Omnibus Budget Reconciliation Act (COBRA), also
134known as COBRA benefits, as COBRA is implemented in
143Section 110.123, Florida Statutes (2005), and Florida
150Administrative Code Rule 60P-2.015. 1
155PRELIMINARY STATEMENT
157By letter dated February 7, 2008, Respondent notified
165Petitioner of the proposed denial of Petitioner's request to
174purchase COBRA benefits following her termination of employment.
182Petitioner timely requested an administrative hearing, and
189Respondent referred the matter to DOAH to conduct the hearing.
199At the hearing, Petitioner testified, presented the
206testimony of two additional witnesses, and submitted 44 exhibits
215for admission into evidence. Respondent called four witnesses
223and submitted nine exhibits.
227The identity of the witnesses and exhibits and the rulings
237regarding each are set forth in the record of the hearing.
248Neither party filed a transcript of the hearing with DOAH.
258However, Petitioner represented at the hearing that she would
267order a transcript, discovered the cost of a transcript,
276attempted to obtain a transcript through a public records
285request, and requested the undersigned to order the court
294reporter to provide a transcript. The delay created confusion
303for opposing counsel, and, pursuant to a motion from Petitioner,
313the ALJ ordered the parties to file their respective proposed
323recommended orders (PROs) no later than August 20, 2008. The
333parties timely filed their PROs on August 20, 2008.
342FINDINGS OF FACT
3451. Petitioner is a former state employee who participated
354in the states Group Insurance Program (GIP) until the
363termination of her employment on November 3, 2005. Respondent
372is the state agency responsible for the administration of GIP.
3822. Respondent contracts with an entity identified in the
391record as Convergys, Inc. (Convergys), for human resources
399management services. Convergys provides the principal part of
407its management services through an on-line computer system
415identified in the record as People First. However, final
424decisions concerning insurance coverage under GIP are
431statutorily prohibited from being delegated to Convergys. 2
4393. Health insurance premiums for state employees are paid
448one month in advance. Petitioner was a state employee at least
459one day in November 2005. Her participation and health
468insurance coverage through GIP continued through December 2005.
4764. It is undisputed that Petitioner was entitled to elect
486COBRA benefits for 18 months following the termination of her
496employment. It is also undisputed that Petitioner was required
505to elect COBRA benefits no later than March 1, 2006,
515approximately 60 days after December 31, 2005, when Petitioners
524participation in GIP ended.
5285. The employing agency sent Convergys a notice of
537termination of employment. The People First system
544automatically generated a COBRA notice on November 16, 2005.
553The COBRA notice, in relevant part, informed Petitioner that an
563election of COBRA benefits must be exercised no later than
573March 1, 2006. Petitioners first contact with Convergys
581regarding her COBRA benefits was on March 23, 2006.
5906. Petitioner claims she never received the COBRA notice.
599Convergys mailed the COBRA notice to the address of record for
610Petitioner at 730 East Lake Shore Boulevard, Kissimmee, Florida.
619Petitioner owned the house at the address of record, but the
630house had been damaged. Prior to September 7, 2005, Petitioner
640had changed her residence but continued to pick up the mail
651delivered to the address of the damaged house. Prior to
661March 23, 2006, Petitioner did not notify her employer or
671Convergys of a change of address.
6777. On September 7, 2005, the personnel office of the
687employing agency sent a memorandum to agency employees,
695including Petitioner, that included directions for updating
702addresses of record. Petitioner did not take the action
711directed in the memorandum. Rather, Petitioner completed a form
720used by her supervisor for the supervisors individual use and
730mistakenly assumed that her action was sufficient to notify
739Convergys of a change in her address of record.
7488. While Petitioner was an active employee, she could
757change her address of record either through the personnel
766office, in accordance with the memorandum Petitioner received on
775September 7, 2005, or on-line through People First. Employees
784of Convergys cannot permanently change the address of record of
794an active employee. Once Petitioner terminated her employment,
802an address change could only be made on-line through People
812First.
8139. The security function of the People First system notes
823any access into an employees account. No address change was
833made in Petitioners account. The COBRA notice was sent to the
844address of record and was not returned.
85110. Petitioner did not elect COBRA benefits on or before
861March 1, 2006. Petitioner is not entitled to continuation
870benefits under COBRA.
873CONCLUSIONS OF LAW
87611. DOAH has jurisdiction over the parties to and the
886subject matter of this proceeding. §§ 120.569 and 120.57(1),
895Fla. Stat. (2008). DOAH provided the parties with adequate
904notice of the final hearing.
90912. Petitioner has the burden of proof in this proceeding.
919Petitioner must show by a preponderance of the evidence that she
930is entitled to COBRA benefits pursuant to Subsection 110.123(5)
939and Rule 60P-2.015. Young v. Department of Community Affairs ,
948625 So. 2d 831 (Fla. 1993); Florida Department of Transportation
958v. J.W.C. Co. , 396 So. 2d 778 (Fla. 1st DCA 1981); and Balino v.
972Department of Health and Rehabilitative Services , 348 So. 2d 349
982(Fla. 1st DCA 1977).
98613. Rule 60P-2.015(6), in relevant part, requires
993Petitioner to apply for continuation coverage within 60 calendar
1002days after notification of eligibility. The COBRA notice
1010notified Petitioner that she must elect COBRA benefits no later
1020than March 1, 2006. For reasons stated in the Findings of Fact
1032and not repeated here, Petitioner did not elect COBRA benefits
1042in a timely manner and is not entitled to continuation coverage.
1053RECOMMENDATION
1054Based on the foregoing Findings of Fact and Conclusions of
1064Law, it is
1067RECOMMENDED that Respondent enter a final order denying
1075Petitioner's application to purchase COBRA benefits.
