93STATEMENT OF THE ISSUE
97The issue in the case is whether an application for a motor
109vehicle dealer license filed by Lambretta International, LLC,
117and Retro Unlimited, Inc., should be approved.
124PRELIMINARY STATEMENT
126By Notice published in the Florida Administrative Weekly
134(Volume 34, Number 15, April 11, 2008) the Department of Highway
145Safety and Motor Vehicles (Department) gave notice that
153Petitioner Lambretta International, LLC, was seeking to
160establish a new point motor vehicle dealership in
168St. Petersburg, Florida, with Petitioner Retro Unlimited, Inc.
176A challenge to the establishment of the dealership was filed
186with the Department by an existing motorcycle dealership,
194Scooter Escapes, LLC, d/b/a Scooter Escapes (Respondent).
201By letter dated May 16, 2008, the Department forwarded the
211challenge to DOAH. On May 21, 2008, an Initial Order was
222issued, directing the parties to identify the anticipated length
231of the hearing and dates upon which the parties were available.
242No response was filed by either party. The Administrative Law
252Judge thereafter scheduled the hearing for July 30, 2008, in
262Tallahassee, Florida. No party filed any objection related to
271the date or location of the scheduled hearing.
279At the time of the hearing, there was no appearance by
290Petitioners Lambretta International, LLC, or Retro Unlimited,
297Inc. Chris Densmore, the owner of the Respondent, appeared at
307the hearing to represent the Respondent.
313There were no witnesses or exhibits admitted into evidence.
322No transcript of the hearing was filed. No proposed recommended
332orders were filed.
335FINDING OF FACT
3381. There is no evidence that the existing franchise dealer
348is not providing adequate representation within the territory of
357the motor vehicles at issue in this proceeding.
365CONCLUSIONS OF LAW
3682. The Division of Administrative Hearings has
375jurisdiction over the parties to and subject matter of this
385proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).
3933. Subsection 320.642(2)(a), Florida Statutes (2007),
399provides as follows:
402An application for a motor vehicle dealer
409license in any community or territory shall
416be denied when:
4191. A timely protest is filed by a presently
428existing franchised motor vehicle dealer
433with standing to protest as defined in
440subsection (3); and
4432. The licensee fails to show that the
451existing franchised dealer or dealers who
457register new motor vehicle retail sales or
464retail leases of the same line-make in the
472community or territory of the proposed
478dealership are not providing adequate
483representation of such line-make motor
488vehicles in such community or territory.
494The burden of proof in establishing
500inadequate representation shall be on the
506licensee. (Emphasis supplied)
5094. The licensee in this case is Petitioner Lambretta
518International, LLC. See §§ 320.60(8) and 320.61, Fla. Stat.
527(2007).
5285. As the licensee, Petitioner Lambretta International,
535LLC, has the burden of establishing compliance with applicable
544statutory requirements by a preponderance of the evidence.
552Dept. of Banking and Finance, Div. of Securities and Investor
562Protection v. Osborne Stern & Co. , 670 So. 2d 932 (Fla. 1996).
574The failure to appear at the hearing or to otherwise provide
585competent evidence precludes the Petitioners from meeting the
593burden in this case. Accordingly, the application for a motor
603vehicle dealer license at issue in this proceeding must be
613denied.
6146. On July 28, 2008, two days prior to the hearing,
625various documents were filed with DOAH which appear to allege
635that the line-make at issue in this proceeding is not the same
647as the line-make sold by the Respondent. The documents are
657uncorroborated hearsay and can not serve as the basis for any
668factual findings in this case. See § 120.57(1)(c), Fla. Stat.
678(2007).
679RECOMMENDATION
680Based on the foregoing Finding of Fact and Conclusions of
690Law, it is RECOMMENDED that the Department of Highway Safety and
701Motor Vehicles enter a final order denying the application for
711establishment of the motor vehicle dealer franchise at issue in
721this case.
