108STATEMENT OF THE ISSUES
112The issues in this case are whether Respondent violated
121Subsections 475.624(14) and 475.624(15), Florida Statutes
127(2005), 1 and if so, what discipline should be imposed.
137PRELIMINARY STATEMENT
139On October 3, 2007, Petitioner, Department of Business and
148Professional Regulation, Division of Real Estate (Department),
155filed a ten-count Administrative Complaint against Respondent,
162Cathy C. Pfeiffer (Ms. Pfeiffer), alleging that she had violated
172Subsections 475.6221(2), 475.624(4), 475.624(2), 475.624(15),
177and 475.624(14) and Section 475.6222, Florida Statutes, and
185various provisions of the Uniform Standards of Professional
193Appraisal Practice (USPAP) (2006). Ms. Pfeiffer requested an
201administrative hearing, and the case was forwarded to the
210Division of Administrative Hearings on July 7, 2008, for
219assignment of an Administrative Law Judge to conduct the final
229hearing. The case was originally assigned to Administrative Law
238Judge P. Michael Ruff, but was transferred to Administrative Law
248Judge Susan B. Harrell to conduct the final hearing.
257The final hearing was continued several times. On
265November 18, 2008, Petitioner filed a Motion to Amend
274Administrative Complaint, requesting that the references to the
282USPAP be changed to the 2005 2 version rather than the 2006
294version. At the final hearing, the motion was granted, and the
305Amended Administrative Complaint was deemed filed as of
313December 1, 2008.
316At the final hearing, counsel for the Department stated
325that the Department was withdrawing Counts I, II, III, VI, VII,
336and VIII. Thus, the remaining counts in the Amended
345Administrative Complaint at issue are Counts, IV, V, IX, and X.
356At the final hearing, the Department called Diana Lynn Wood
366and Paul Andrew Grimes as its witnesses. Petitioners
374Exhibits 1 through 7 were admitted in evidence. Ms. Pfeiffer
384testified in her own behalf and called Philip Miller and
394John William Priller, Sr., as her witnesses. Respondents
402Exhibits 1 through 6, 8 through 11, 14, and 15 were admitted in
415evidence.
416The one-volume Transcript was filed on January 5, 2009.
425The parties agreed to file their proposed recommended orders
434within ten days of the filing of the Transcript. The parties
445timely filed their Proposed Recommended Orders, which have been
454considered in the writing of this Recommended Order.
462FINDINGS OF FACT
4651. At all times material to this proceeding, Ms. Pfeiffer
475was a certified residential appraiser licensed by the State of
485Florida, License No. RD3059. She first became licensed in 1998.
4952. On June 12, 2006, Ms. Pfeiffer accepted an assignment
505from Diane Purser to appraise her home located in Gulf Breeze,
516Florida. Mrs. Purser was in the midst of a divorce proceeding
527with her husband Mark Purser and wanted to have the appraisal to
539determine the market value of their home prior to a meeting with
551her attorney. Mrs. Purser wanted the appraisal to be expedited.
5613. Ms. Pfeiffer gave the appraisal assignment to Brian
570Choron, who, at that time, was a registered trainee real estate
581appraiser, License No. RI-10526. Ms. Pfeiffer was Mr. Chorons
590supervisor.
5914. Mr. Choron went to Mrs. Pursers home and physically
601inspected the home while Mr. and Mrs. Purser were present.
6115. Mr. Choron developed an appraisal report of the Purser
621property. Mr. Choron extracted data from appraisals of other
630property in the area in developing the report on the Purser
641property. This is not an uncommon practice in the appraisal
651profession.
6526. Mr. Choron sent the appraisal report to Ms. Pfeiffer
662for her review. Ms. Pfeiffer reviewed the report and sent it to
674Mrs. Purser. Ms. Pfeiffer signed the appraisal on June 15,
6842006, as the appraiser. Mr. Choron did not sign the appraisal.
6957. By signing the appraisal report as the appraiser,
704Ms. Pfeiffer certified, among other things, that she had
713performed a complete visual inspection of the interior and
722exterior areas of the subject property. Additionally, she
730certified the following:
733I personally prepared all conclusions and
739opinions about the real estate that were set
747forth in this appraisal report. If I relied
755on significant real property appraisal
760assistance from any individual or
765individuals in the performance of this
771appraisal or the preparation of the
777appraisal report, I have named such
783individual(s) and disclosed the specific
788tasks performed in this appraisal report. I
795certify that any individual so named is
802qualified to perform the tasks. I have not
810authorized anyone to make a change to any
818item in this appraisal report; therefore,
824any changes made to this appraisal is
831unauthorized and I will take no
837responsibility for it.
840On page four 3 of the appraisal report, Ms. Pfeiffer stated:
851Brian Choron RI10526 assisted in the research, inspection,
859preparation of this appraisal report. On page 17 of the
869appraisal report, Ms. Pfeiffer indicated that she had inspected
878the property.
8808. Ms. Pfeiffer admits that she incorrectly signed the
889appraisal report as the appraiser, that she should have signed
899as the supervisory appraiser, and that Mr. Choron should have
909signed the appraisal report as the appraiser.
9169. The appraisal report listed the effective date of the
926appraisal as June 14, 2006. The final estimated value of the
937Purser property was listed as $275,000.00.
94410. Mr. Purser contacted Ms. Pfeiffer and was upset about
954some discrepancies which he perceived to be in the appraisal
964report. Ms. Pfeiffer and Mr. Choron developed a revised
973appraisal report, hereinafter referred to as the revised
981appraisal. The revised appraisal was communicated to
988Mrs. Purser in October 2006. The final estimated value of the
999property was listed the same as it was in the original
1010appraisal, $275,000.00.
101311. The revised appraisal listed Mr. Choron as the
1022appraiser. On page 8 of the revised appraisal, Mr. Choron
1032signed the revised appraisal as the appraiser with a signature
1042date of June 15, 2006. On the same page of the revised
1054appraisal, Ms. Pfeiffer signed the revised appraisal as the
1063supervisory appraiser with a signature date of June 15, 2006.
1073She also indicated on that page that she had not inspected the
1085property.
108612. On page 18 of the revised appraisal, Mr. Choron signed
1097the revised appraisal as the appraiser with a signature date of
1108October 20, 2006. Ms. Pfeiffer signed on the same page as the
1120supervisory appraiser with a signature date of June 15, 2006.
1130Ms. Pfeiffer checked boxes on page 18 of the revised appraisal,
1141indicating that she both did and did not inspect the property.
115213. There are no issues with the valuation of the Purser
1163property. None of the experts who testified at the final
1173hearing found fault with the market value placed on the
1183property.
1184CONCLUSIONS OF LAW
118714. The Division of Administrative Hearings has
1194jurisdiction over the parties to and the subject matter of this
1205proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).
121315. The Department has the burden to establish the
1222allegations in the Amended Administrative Complaint by clear and
1231convincing evidence. Department of Banking and Finance v.
1239Osborne Stern and Co. , 670 So. 2d 932 (Fla. 1996). In
1250Counts IV, V, IX, and X of the Amended Administrative Complaint,
1261the Department alleges that Ms. Pfeiffer violated Subsections
1269475.624(14) and 475.624(15), Florida Statutes, which provide:
1276The board may deny an application for
1283registration, licensure, or certification;
1287may investigate the actions of any appraiser
1294registered, licensed, or certified under
1299this part; may reprimand or impose an
1306administrative fine not to exceed $5,000 for
1314each count or separate offense against any
1321such appraiser; and may revoke or suspend,
1328for a period not to exceed 10 years, the
1337registration, license, or certification of
1342any such appraiser, or place any such
1349appraiser on probation, if it finds that the
1357registered trainee, licensee, or
1361certificateholder:
1362* * *
1365(14) Has violated any standard for the
1372development or communication of a real
1378estate appraisal or other provision of the
1385Uniform Standards of Professional Appraisal
1390Practice.
1391(15) Has failed or refused to exercise
1398reasonable diligence in developing an
1403appraisal or preparing an appraisal report.
140916. The Department also alleged in the Amended
1417Administrative Complaint that Ms. Pfeiffer violated Rules 2-1(a)
1425and 2-3 of the USPAP, which provide:
14322-1 Each written or oral real property
1439appraisal report must:
1442(a) clearly and accurately set forth the
1449appraisal in a manner that will not be
1457misleading;
1458* * *
14612-3 (This Standards Rule contains binding
1467requirements from which departure is not
1473permitted.)
1474Each written real property appraisal report
1480must contain a signed certification that is
1487similar in content to the following form:
1494I certify that, to the best of my knowledge
1503and belief:
1505--the statements of fact contained in this
1512report are true and correct.
1517--the reported analyses, opinions, and
1522conclusions are limited only by the reported
1529assumptions and limiting conditions that are
1535my personal, impartial, and unbiased
1540professional analyses, opinions, and
1544conclusions.
1545--I have no (or the specified) present or
1553prospective interest in the property that is
1560the subject of this report and no (or the
1569specified) personal interest with respect to
1575the parties involved.
1578--I have no bias with respect to the
1586property that is the subject of this report
1594or to the parties involved with this
1601assignment.
1602--my engagement in this assignment was not
1609contingent upon developing or reporting
1614predetermined results.
1616--my compensation for completing this
1621assignment is not contingent upon the
1627development or reporting of a predetermined
1633value or direction in value that favors the
1641cause of the client, the amount of the value
1650opinion, the attainment of a stipulated
1656result, or the occurrence of a subsequent
1663event directly related to the intended use
1670of this appraisal.
1673--my analyses, opinions, and conclusions
1678were developed, and this report has been
1685prepared, in conformity with the Uniform
1691Standards of Professional Appraisal
1695Practice .
1697--I have (or have not) made a personal
1705inspection of the property that is the
1712subject of this report. (If more than one
1720person signs this certification, the
1725certification must clearly specify which
1730individuals and which individuals did not
1736make personal inspection of the appraised
1742property.)
1743--no one provided significant real property
1749appraisal assistance to the person signing
1755this certification. (If there are
1760exceptions, the name of each individual
1766providing significant real property
1770appraisal assistance must be stated.)
177517. The Department has established by clear and convincing
1784evidence that Ms. Pfeiffer did not use reasonable diligence in
1794preparing the original appraisal report in violation of
1802Subsection 475.624(15), Florida Statutes. She signed the
1809appraisal report as the appraiser and indicated that she had
1819inspected the property. However, she did acknowledge in the
1828appraisal report that Mr. Choron had assisted in the inspection,
1838research, and preparation of the report.
184418. By certifying in the original appraisal report that
1853she had inspected the property, she violated Rule 2-3 of the
1864USPAP and therefore violated Subsection 475.624(14), Florida
1871Statutes.
187219. The evidence did not establish that Ms. Pfeiffer
1881intentionally tried to mislead her client in the preparation of
1891the appraisal report. Mr. and Mrs. Purser were present when
1901Mr. Choron physically inspected the property. Ms. Pfeiffer
1909issued a revised appraisal when showed that Mr. Choron was the
1920appraiser who did the appraisal. In the revised appraisal,
1929Ms. Pfeiffer indicated in one section that she did not inspect
1940the property but in another section indicated that she did and
1951did not inspect the property. Again, since the Pursers were
1961present when Mr. Choron inspected the property, they had
1970knowledge of who actually inspected the property and would not
1980have been misled by the statements in the revised appraisal.
199020. In the revised report, both Mr. Choron and
1999Ms. Pfeiffer put the signature date of the report as June 15,
20112006, on page 8 of the revised report. On page 18 of the
2024revised appraisal, Mr. Choron put a signature date of
2033October 20, 2006, and Ms. Pfeiffer put a signature date of
2044June 15, 2006. Again, the report was not proofed in a diligent
2056manner, but there was no attempt to intentionally mislead the
2066client. The Department has failed to establish that
2074Ms. Pfeiffer violated Rule 2-1(a) of the USPAP.
208221. Florida Administrative Code Rule 61J1-8.002 sets forth
2090the disciplinary guidelines to be used by the Florida Real
2100Estate Appraisal Board (Board). The guidelines list the usual
2109range of penalties for a violation of Subsections 475.624(14)
2118and 475.624(15), Florida Statutes, as a five-year suspension to
2127revocation and administrative fine of $1,000.00. Florida
2135Administrative Code Rule 61J1-8.002(4) provides that the Board
2143may deviate from the guidelines when there are aggravating or
2153mitigating circumstances.
215522. Ms. Pfeiffer has demonstrated mitigating circumstances
2162that would require a lesser penalty than those listed in the
2173penalty guidelines. There was no harm to the consumer or
2183public. The market value assigned to the Purser property was
2193proper. There was no intent to mislead Mrs. Purser about who
2204inspected the property because Mrs. Purser was present when the
2214property was inspected by Mr. Choron. Ms. Pfeiffer tried to
2224correct her errors in the revised report.
223123. No evidence was presented by the Department as to the
2242amount of costs incurred in the investigation and prosecution of
2252this case.
2254RECOMMENDATION
2255Based on the foregoing Findings of Fact and Conclusions of
2265Law, it is RECOMMENDED that a final order be entered finding
2276Ms. Pfeiffer guilty of violating Subsections 475.624(14) and
2284475.624(15), Florida Statutes, and Rule 2-3 of the USPAP;
2293dismissing Count IX of the Amended Administrative Complaint;
2301placing Ms. Pfeiffer on probation for two years; imposing an
2311administrative fine of $1,000.00; and requiring Ms. Pfeiffer to
2321complete the 15-hour USPAP course.
