99STATEMENT OF THE ISSUE
103The issue in the case is whether an application for a motor
115vehicle dealer license filed by LS Motorsports, LLC, and
124Michael J. Konczal, Inc., should be approved.
131PRELIMINARY STATEMENT
133By notice published in the Florida Administrative Weekly
141(Volume 34, Number 29; July 18, 2008) the Department of Highway
152Safety and Motor Vehicles (Department) gave notice that
160LS MotorSports, LLC (LS MotorSports), was seeking to establish a
170new point motor vehicle dealership in St. Petersburg, Florida,
179with Michael J. Konczal, Inc., for the line-make "Jiangsu Linhai
189Power Machinery Group (LINH)." A challenge to the establishment
198of the dealership was filed with the Department by an existing
209motorcycle dealership, Scooter Escapes (Respondent).
214By letter dated August 25, 2008, the Department forwarded
223the challenge to the Division of Administrative Hearings. On
232August 28, 2008, an Initial Order was issued, directing the
242parties to identify the anticipated length of the hearing and
252dates upon which the parties were available. The Order stated
262that failure to respond would be deemed a waiver of venue rights
274in which event the hearing would be scheduled in Tallahassee.
284No response to the Initial Order was filed. The hearing was
295scheduled in Tallahassee for March 5, 2009, a date in accordance
306with Section 320.699(2), Florida Statutes (2008).
312At the hearing, there was no appearance by, or on behalf
323of, either Petitioner. The Respondent's owner, Chris Densmore,
331testified on behalf of the Respondent. No exhibits were offered
341into evidence. No transcript of the hearing was filed. No
351Proposed Recommended Orders were filed.
356FINDINGS OF FACT
3591. LS MotorSports is seeking to establish a new point
369motor vehicle dealership in St. Petersburg, Florida, for line-
378make LINH.
3802. The Respondent is an existing franchise motor vehicle
389dealer for line-make LINH, located within 12.5 miles of the
399proposed new point motor vehicle dealership location. The
407majority of the Respondent's vehicle sales come from within a
41712.5-mile radius of the proposed dealership.
4233. The Respondent timely filed a protest of
431LS MotorSports proposed dealership.
4354. There is no evidence that the Respondent is not
445providing adequate representation within the territory of the
453motor vehicles at issue in this proceeding.
460CONCLUSIONS OF LAW
4635. The Division of Administrative Hearings has
470jurisdiction over the parties to and subject matter of this
480proceeding. §§ 120.569 and 120.57, Fla. Stat. (2008).
4886. Subsection 320.642(2)(a), Florida Statutes (2008),
494provides as follows:
497An application for a motor vehicle dealer
504license in any community or territory shall
511be denied when:
5141. A timely protest is filed by a presently
523existing franchised motor vehicle dealer
528with standing to protest as defined in
535subsection (3); and
5382. The licensee fails to show that the
546existing franchised dealer or dealers who
552register new motor vehicle retail sales or
559retail leases of the same line-make in the
567community or territory of the proposed
573dealership are not providing adequate
578representation of such line-make motor
583vehicles in such community or territory.
589The burden of proof in establishing
595inadequate representation shall be on the
601licensee. (Emphasis supplied)
6047. The licensees in this case are Petitioners
612LS Motorsports, LLC, and Michael J. Konczal, Inc. See
621§§ 320.60(8) and 320.61, Fla. Stat. (2008).
6288. As the licensees, the Petitioners have the burden of
638establishing compliance with applicable statutory requirements
644by a preponderance of the evidence presented at the hearing.
654§ 320.642(2)(a)2., Fla. Stat. (2008). The Petitioners have
662failed to establish that the Respondent is not providing
671adequate representation of the line-make LINH.
677RECOMMENDATION
678Based on the foregoing Finding of Fact and Conclusions of
688Law, it is RECOMMENDED that the Department of Highway Safety and
699Motor Vehicles enter a final order denying the application for
709establishment of the motor vehicle dealer franchise at issue in
719this case.
