100STATEMENT OF THE ISSUES
104The issues in this case are whether the respondents
113practiced contracting without a license in violation of
121Florida Statutes (2004), 1 and, if so, what penalty, if any,
132should be imposed pursuant to Chapters 455 and 489, as alleged
143in the Administrative Complaint.
147PRELIMINARY STATEMENT
149On January 14, 2008, Petitioner filed an Administrative
157Complaint against the respondents. The respondents requested an
165administrative hearing. Petitioner referred the request to DOAH
173to conduct the hearing.
177At the hearing, Petitioner presented the testimony of two
186witnesses and submitted 14 exhibits for admission into evidence.
195Abraham Cowrie did not testify. The respondents did not call
205any witnesses and did not submit any exhibits.
213The identity of the witnesses and exhibits and the rulings
223regarding each are reported in the two-volume Transcript of the
233hearing filed on May 18 and October 12, 2009. Petitioner timely
244filed its Proposed Recommended Order (PRO) on October 22, 2009.
254The respondents did not file a PRO.
261FINDINGS OF FACT
2641. Petitioner is the state agency authorized to regulate
273the construction industry in Florida pursuant to Chapter 489.
282Abraham Cowrie is the sole shareholder and president of Sunshine
292Homes & Apartments, Inc. (Sunshine Homes). Neither Mr. Cowrie
301nor Sunshine Homes has ever been licensed as a contractor in
312Florida.
3132. From December 23, 2004, through November 30, 2006,
322Mr. Cowrie and Sunshine Homes practiced contracting, within the
331meaning of Subsections 489.105(3) and (6), 489.113(2), and
339489.127(1)(f), by contracting with Boboy Ramnanan to build a
348home at Mr. Ramnanan's property in Palm Bay, Florida; completing
358part of the work; and accepting $227,020.00 in payment.
368Mr. Cowrie and Sunshine Homes did not complete the job and did
380not refund any of the construction costs. The homeowner
389incurred additional costs to contract with a licensed contractor
398to complete the job.
4023. On or about December 23, 2004, Mr. Cowrie and Sunshine
413Homes contracted with Mr. Ramnanan to build a home at the
424homeowner's property in Palm Bay, Florida. A certified general
433contractor, identified in the record as Sharma Baboolal and the
443qualifier of Terra Mar Construction, Inc. (Terra Mar), obtained
452the necessary permits for the construction.
4584. Mr. Baboolal and the homeowner never met in person.
468The homeowner never executed a contract with Mr. Baboolal or
478Terr Mar.
4805. The homeowner paid Mr. Cowrie and Sunshine Homes
489approximately $227,020.00 through wire transfers and checks from
498January 25, 2005, through November 30, 2006. Neither Mr. Cowrie
508nor Sunshine Homes was employed by Mr. Baboolal or Terra Mar.
5196. Mr. Cowrie and Sunshine Homes did not finish the
529construction work. Mr. Cowrie and Sunshine Homes did not refund
539any of the money received from the homeowner. The money that
550the homeowner paid to Mr. Cowrie and Sunshine Homes was intended
561as full payment for a completed project. The costs of
571Petitioner's investigation total $55.17, excluding legal and
578prosecuting costs.
580CONCLUSIONS OF LAW
5837. DOAH has jurisdiction over the subject matter of and
593parties to this proceeding. §§ 120.569 and 120.57(1), Fla.
602Stat. (2009). DOAH provided the parties with adequate notice of
612the formal hearing.
6158. Petitioner has the burden of proof in this proceeding.
625Petitioner must show by clear and convincing evidence that each
635licensee committed the acts alleged in the Administrative
643Complaint and the reasonableness of the proposed penalty.
651Ferris v. Turlington , 510 So. 2d 292 (Fla. 1987).
6609. Petitioner satisfied its burden of proof. Petitioner
668showed by clear and convincing evidence that Mr. Cowrie and
678Sunshine Homes practiced contracting without a license in
686violation of Subsections 489.105(3) and (6), 489.113(2), and
694489.127(1)(f).
69510. In Petitioner's PRO, Petitioner seeks a penalty of
704$5,000.00 authorized in Subsection 455.228(1). The ALJ finds
713the proposed penalty to be reasonable under the facts and
723circumstances in this case. Petitioner also satisfied its
731burden of proving entitlement to the recovery of investigative
740costs in the amount of $55.17.
746RECOMMENDATION
747Based upon the foregoing Findings of Fact and Conclusions
756of Law, it is
760RECOMMENDED that Petitioner enter a final order finding
768Mr. Cowrie and Sunshine Homes guilty of committing the
777violations alleged in the Administrative Complaint and imposing
785an aggregate administrative fine of $5,000.00 against both of
795the respondents.
