141STATEMENT OF THE ISSUE
145The issue is whether Petitioners are entitled to motor
154vehicle dealerships that are proposed to be located in Orange
164County, Florida.
166PRELIMINARY STATEMENT
168On June 12, 2009, Petitioner, Red Streak Scooters, LLC, and
178Scooter City USA, LLC, published a Notice of Publication for a
189New Point Franchise Motor Vehicle Dealer in a County of More
200Than 300,000 Population ("Notice of Publication"), Florida
210Administrative Weekly , Volume 35, Number 23, for two different
219locations in Orange County, Florida.
224On June 21, 2009, Respondent, Jude A. Mitchell, d/b/a
233Judes Cycle Service ("Respondent"), timely filed protests for
243each Notice of Publication with the Department of Highway Safety
253and Motor Vehicles ("Department").
259By letter dated June 25, 2009, the Department referred the
269matters to the Division of Administrative Hearings ("DOAH") for
280assignment of an Administrative Law Judge to conduct a hearing
"290for the sole purpose of determining the propriety of the
300protest[s] regarding issues specifically within the purview of
308Sections 320.642 and 320.699, Florida Statutes."
314DOAH Case No. 09-3489 was assigned to the protest of the
325proposed dealership at 4535 34th Street, Orlando, Florida; and
334DOAH Case No. 09-3499 was assigned to the protest of the
345proposed dealership at 2650 West Fairbanks Avenue, Winter Park,
354Florida.
355On June 25, 2009, Initial Orders were sent to all parties
366on both cases requesting mutually-convenient dates for a final
375hearing.
376On July 7, 2009, the two related case were consolidated
386pursuant to Florida Administrative Code 28-106.108, and on
394July 22, 2009, a Notice of Hearing was issued scheduling the
405cases to be heard on October 13, 2009.
413Thereafter, on August 7, 2009, Petitioner, Classic
420Motorcycles and Sidecars, Inc., and Scooter City USA, LLC,
429published a Notice of Publication, Florida Administrative
436Weekly , Volume 35, Number 31.
441Respondent timely filed a protest with the Department on
450August 21, 2009. By letter dated August 28, 2009, the
460Department referred this matter to DOAH for an administrative
469hearing. This case was assigned DOAH Case No. 09-4750, and on
480September 1, 2009, an Initial Order was sent to all parties
491requesting mutually-convenient dates for a final hearing.
498On September 15, 2009, Case Nos. 09-3489, 09-3499, and
50709-4750 were consolidated, and on October 6, 2009, an Amended
517Notice of Hearing was issued scheduling all three cases to be
528heard on October 13, 2009.
533Petitioners did not respond to the Order of Pre-hearing
542Instructions mailed on July 22, 2009. The hearing was convened
552as scheduled on October 13, 2009.
558Jude A. Mitchell, representing Jude's Cycle Service,
565testified and presented the testimony of Dennis H. Ruckel. No
575exhibits were offered. No appearance was made on behalf of
585Petitioners.
586The hearing was reported, but not transcribed.
593All statutory references are to Florida Statutes (2009),
601unless otherwise noted.
604FINDINGS OF FACT
607Based on the Notices of Publication, Respondent's protest
615letters which were forwarded to DOAH, and the testimony
624presented at the final hearing, the following Findings of Fact
634are made:
6361. Respondent is an existing franchised dealer for
644motorcycles manufactured by Benzhou Vehicle Industry Group
651Company, Ltd.
6532. Petitioners have proposed the establishment of new
661dealerships to sell the same line-make of motorcycles as those
671sold by Respondent.
6743. Respondent's dealership is located at 3838 John Young
683Parkway, Orlando, Orange County, Florida.
6884. Petitioners' dealerships are proposed to be located in
697Orange County, Florida, at: 4535 34th Street, Orlando, Florida
706(Case No. 09-3489); and 2650 West Fairbanks Avenue, Winter Park,
716Florida (Case Nos. 09-3499 and 09-4750).
7225. The proposed dealerships are within a 12.5-mile radius
731of Respondent's dealership.
7346. Respondent has standing to protest the establishment of
743the proposed dealerships.
7467. No evidence was presented showing that Respondent was
"755not providing adequate representation" of the same line-make
763vehicles in the community or territory.
769CONCLUSIONS OF LAW
7728. The Division of Administrative Hearings has
779jurisdiction over the parties to and the subject matter of this
790proceeding. §§ 120.569 and 120.57(1), Fla. Stat.
7979. The Department is the agency responsible for regulating
806the licensing and franchising of motor vehicle dealers.
814§§ 320.60 through 320.70, Fla. Stat.
82010. Subsection 320.642(1), Florida Statutes, requires a
827motor vehicle dealer who proposes to establish an additional
836motor vehicle dealership within an area already represented by
845the same line-make vehicle to give written notice to the
855Department of Highway Safety and Motor Vehicles of its intent to
866establish a new franchise. The statute also provides that any
876affected dealership may protest the establishment of a new
885franchise in its territory.
88911. Subsection 320.642(2), Florida Statutes, establishes
895the standards of review to determine if establishment of a new,
906competing motor vehicle franchise should be granted. Subsection
914320.642(2)(a), Florida Statutes, provides in relevant part:
921An application for a motor vehicle dealer
928license in any community or territory shall be
936denied when:
9381. A timely protest is filed by a presently
947existing franchised motor vehicle dealer with
953standing to protest as defined in
959subsection (3); and
9622. The licensee fails to show that the
970existing franchised dealer or dealers who
976register new motor vehicle retail sales or
983retail leases of the same line-make in the
991community or territory of the proposed
997dealership are not providing adequate
1002representation of such line-make motor
1007vehicles in such community or territory. The
1014burden of proof in establishing inadequate
1020representation shall be on the licensee.
102612. Pursuant to Subsection 320.642(3)(b)1., Florida
1032Statutes, "if the proposed additional . . . motor vehicle dealer
1043is to be located in a county with a population of more than
1056300,000," as in the instant cases, then any existing motor
1067vehicle dealer of the same line-make whose licensed franchise
1076location is within a radius of 12.5 miles of the proposed
1087additional dealer has standing to file a protest within the
1097meaning of Subsection 320.642(2)(a)1., Florida Statutes.
110313. Respondent is an existing motor vehicle dealer who has
1113standing to file a protest of the proposed new dealerships in
1124these cases.
112614. The burden is, therefore, on Petitioners to prove that
1136there is "inadequate representation" in the community or
1144territory of the proposed new dealerships according to the
1153criteria set forth in Subsection 320.642(2)(b), Florida
1160Statutes.
116115. Petitioners made no appearance and presented no
1169evidence at the final hearing. Petitioners failed to meet their
1179burden of proof.
118216. The approval sought by Petitioners must, therefore, be
1191denied.
1192RECOMMENDATION
1193Based upon the foregoing Findings of Fact and Conclusions
1202of Law, it is
1206RECOMMENDED that the Department of Highway Safety and Motor
1215Vehicles enter a final order denying the establishment of
1224Petitioners' proposed franchise dealerships for Case Nos. 09-3489,
123209-3499, and 09-4750.
