112Whether the Petitioners' proposed dealership should be

120PRELIMINARY STATEMENT
122The Florida Department of Highway Safety and Motor Vehicles
131forwarded the instant case to the Division of Administrative
140Hearings for formal proceedings on August 28, 2009. Thereafter,
149the case was scheduled for hearing and the parties were provided
160notice of the hearing location and time.
167At the hearing, the Respondent, Seminole Scooters, Inc.
175d/b/a Seminole Sales, appeared and was represented by its sales
185manager, David B. Dubin. The Petitioners, Universal Parts,
193Inc., d/b/a PartsForScooters.Com and Eco Green Machine, LLC,
201d/b/a Eco Green Machine did not appear. Mr. Dubin testified and
212presented evidence in opposition to the proposed dealership. No
221evidence was presented in support of the proposed dealership.
230A transcript of the proceeding was not filed. The parties
240were granted ten days from the hearing date within which to file
252proposed recommended orders. The Respondent's proposal filed on
260March 3, 2010, has been considered in the preparation of this
271Recommended Order.
273FINDINGS OF FACT
2761. On August 14, 2009, in the Florida Administrative
285Weekly, Volume 35, Number 32, a Notice of Publication for a New
297Point Franchise Motor Vehicle Dealer in a County of More than
308300,000 Population was published. The notice provided that
317Universal Parts, Inc., d/b/a PartsForScooters.com, intended to
324establish Eco Green Machine, LLC d/b/a Eco Green Machine as a
335dealership for the sale of motorcycles manufactured by Taizhou
344Zhongneng Motorcycle Co. Ltd. (ZHNG) at 7000 Park Boulevard,
353Pinellas Park, Florida 33781, on or after September 4, 2009.
363This proposed dealership was considered a "new point" as it did
374not previously exist.
3772. On August 23, 2009, the Respondent timely filed a
387protest of the establishment of the Petitioners' dealership.
395Respondent alleged that it currently services customers for the
404line-make proposed by the Petitioners and that its location is
414within 12.5 miles of the location proposed by the Petitioners.
4243. The evidence presented established that the
431Respondent's dealership is within two miles of the proposed
440site. Mr. Dubin verified the driving distance and presented the
450measured distance as computed by the website Googlemaps.com as
459Respondent's Exhibit 1.
4624. The Respondent has served the area for not less than
473five years and has successfully promoted the vehicles proposed
482to be sold by the line-make proposed by the Petitioners.
4925. The Respondent established that its sales are within
50112.5 miles of the proposed dealership.
5076. The Respondent established that it currently markets
515the motorcycle to be sold by the proposed dealership. More
525specifically, the Respondent offered testimony that it has an
534agreement for the same line-make vehicle to be sold by the
545proposed dealer.
5477. Notice of the formal hearing was provided to all
557parties of record at their addresses of record.
565CONCLUSIONS OF LAW
5688. The Division of Administrative Hearings has
575jurisdiction over the parties to and the subject matter of these
586proceedings. §§ 120.569, and 120.57(1), Fla. Stat (2009).
5949. Section 320.605, Florida Statutes (2009), provides:
601It is the intent of the Legislature to
609protect the public health, safety, and
615welfare of the citizens of the state by
623regulating the licensing of motor vehicle
629dealers and manufacturers, maintaining
633competition, providing consumer protection
637and fair trade and providing minorities with
644opportunities for full participation as
649motor vehicle dealers.
65210. Section 320.642, Florida Statutes (2009), provides, in
660pertinent part:
662(1) Any licensee who proposes to establish
669an additional motor vehicle dealership or
675permit the relocation of an existing dealer
682to a location within a community or
689territory where the same line-make vehicle
695is presently represented by a franchised
701motor vehicle dealer or dealers shall give
708written notice of its intention to the
715department. Such notice shall state:
720(a) The specific location at which the
727additional or relocated motor vehicle
732dealership will be established.
736(b) The date on or after which the licensee
745intends to be engaged in business with the
753additional or relocated motor vehicle dealer
759at the proposed location.
763(c) The identity of all motor vehicle
770dealers who are franchised to sell the same
778line-make vehicle with licensed locations in
784the county or any contiguous county to the
792county where the additional or relocated
798motor vehicle dealer is proposed to be
805located.
806(d) The names and addresses of the dealer-
814operator and principal investors in the
820proposed additional or relocated motor
825vehicle dealership.
827Immediately upon receipt of such notice the
834department shall cause a notice to be
841published in the Florida Administrative
846Weekly. The published notice shall state
852that a petition or complaint by any dealer
860with standing to protest pursuant to
866subsection (3) must be filed not more than
87430 days from the date of publication of the
883notice in the Florida Administrative Weekly.
889The published notice shall describe and
895identify the proposed dealership sought to
901be licensed, and the department shall cause
908a copy of the notice to be mailed to those
918dealers identified in the licensee's notice
924under paragraph (c).
927(2)(a) An application for a motor vehicle
934dealer license in any community or territory
941shall be denied when :
9461. A timely protest is filed by a presently
955existing franchised motor vehicle dealer
960with standing to protest as defined in
967subsection (3); and
9702. The licensee fails to show that the
978existing franchised dealer or dealers who
984register new motor vehicle retail sales or
991retail leases of the same line-make in the
999community or territory of the proposed
1005dealership are not providing adequate
1010representation of such line-make motor
1015vehicles in such community or territory.
1021The burden of proof in establishing
1027inadequate representation shall be on the
1033licensee .
1035* * *
1038(3) An existing franchised motor vehicle
1044dealer or dealers shall have standing to
1051protest a proposed additional or relocated
1057motor vehicle dealer where the existing
1063motor vehicle dealer or dealers have a
1070franchise agreement for the same line-make
1076vehicle to be sold or serviced by the
1084proposed additional or relocated motor
1089vehicle dealer and are physically located so
1096as to meet or satisfy any of the following
1105requirements or conditions:

1111(b) If the proposed additional or relocated
1118motor vehicle dealer is to be located in a
1127county with a population of more than
1134300,000 according to the most recent data of
1143the United States Census Bureau or the data
1151of the Bureau of Economic and Business
1158Research of the University of Florida:
11641. Any existing motor vehicle dealer or
1171dealers of the same line-make have a
1178licensed franchise location within a radius
1184of 12.5 miles of the location of the
1192proposed additional or relocated motor
1197vehicle Dealer. . . . (Emphasis Added)
120411. The Respondent established as a matter of law that it
1215has standing to protest the proposed dealership. The
1223Petitioners presented no evidence to support a conclusion that
1232the Respondent has failed to provide adequate representation of
1241the line-make motor vehicles in the community or territory
1250surrounding the proposed site.
125412. The record in this cause is devoid of any evidence
1265supporting the proposed dealership.
1269RECOMMENDATION
1270Based on the foregoing Findings of Fact and Conclusions of
1280Law, it is RECOMMENDED that the Florida Department of Highway
1290Safety and Motor Vehicles enter a final order denying the
1300approval of the Petitioners' proposed dealership.
