90The issue in the case is whether an application for a new

102point franchise motor vehicle dealership filed by El Sol

111Trading, Inc., and Fishers Auction Services, Inc., d/b/a Fisher

120Auto Equipment Sales (Petitioners), should be approved.

127PRELIMINARY STATEMENT

129By Notice published in the Florida Administrative Weekly

137(Volume 35, Number 45; November 13, 2009), the Department of

147Highway Safety and Motor Vehicles (Department) gave notice that

156El Sol Trading, Inc., was seeking to establish a new point

167franchise motor vehicle dealership for the sale of motorcycles

176manufactured by Shanghai Shenke Motorcycle Co., Ltd. (SHEN) with

185Fishers Auction Services, Inc., d/b/a Fisher Auto Equipment

193Sales, at 402 North Ridgewood Avenue, Edgewater (Volusia

201County), Florida 32132.

204Cycles and More, Inc. (Respondent), filed a challenge to

213the establishment of the dealership. By letter dated December

22211, 2009, the Department forwarded the challenge to DOAH. On

232December 15, 2009, DOAH issued an Initial Order, directing the

242parties to identify the anticipated length of the hearing, dates

252upon which the parties were available for hearing, and a

262suggested hearing location. No responses to the Initial Order

271were filed, and the hearing was to begin at 9:00 a.m., on

283June 18, 2010, in New Smyrna Beach as set forth in the Notice of

297Hearing filed January 4, 2010.

302Neither party appeared at the time scheduled for

310commencement of the hearing. There were no witnesses or

319exhibits admitted into evidence. No transcript of the hearing

328was filed. No proposed recommended orders were filed.

336FINDINGS OF FACT

3391. There was no evidence presented at the hearing to

349establish that Respondent has a franchise agreement to sell or

359service SHEN motor vehicles, the line-make to be sold by Cycles

370and More, Inc.

3732. There was no evidence presented at the hearing that

383Respondent's dealership is physically located so as to meet the

393statutory requirements for standing to protest the establishment

401of the new point franchise motor vehicle dealership.

409CONCLUSIONS OF LAW

4123. The Division of Administrative Hearings has

419jurisdiction over the parties to and subject matter of this

429proceeding. §§ 120.569 and 120.57, Fla. Stat. (2009).

4374. Section 320.642, Florida Statutes (2009), provides in

445relevant part as follows:

449320.642 Dealer licenses in areas previously

455served; procedure.--

457(1) Any licensee who proposes to establish

464an additional motor vehicle dealership or

470permit the relocation of an existing dealer

477to a location within a community or

484territory where the same line-make vehicle

490is presently represented by a franchised

496motor vehicle dealer or dealers shall give

503written notice of its intention to the

510department. . . .

517(2)(a) An application for a motor vehicle

524dealer license in any community or territory

531shall be denied when:

5351. A timely protest is filed by a presently

544existing franchised motor vehicle dealer

549with standing to protest as defined in

556subsection (3); and

5592. The licensee fails to show that the

567existing franchised dealer or dealers who

573register new motor vehicle retail sales or

580retail leases of the same line-make in the

588community or territory of the proposed

594dealership are not providing adequate

599representation of such line-make motor

604vehicles in such community or territory.

610The burden of proof in establishing

616inadequate representation shall be on the

622licensee.

626(3) An existing franchised motor vehicle

632dealer or dealers shall have standing to

639protest a proposed additional or relocated

645motor vehicle dealer when the existing motor

652vehicle dealer or dealers have a franchise

659agreement for the same line-make vehicle to

666be sold or serviced by the proposed

673additional or relocated motor vehicle dealer

679and are physically located so as to meet or

688satisfy any of the following requirements or

695conditions:

699(b) If the proposed additional or relocated

706motor vehicle dealer is to be located in a

715county with a population of more than

722300,000 according to the most recent data of

731the United States Census Bureau or the data

739of the Bureau of Economic and Business

746Research of the University of Florida:

7521. Any existing motor vehicle dealer or

759dealers of the same line-make have a

766licensed franchise location within a radius

772of 12.5 miles of the location of the

780proposed additional or relocated motor

785vehicle dealer; or

7882. Any existing motor vehicle dealer or

795dealers of the same line-make can establish

802that during any 12-month period of the 36-

810month period preceding the filing of the

817licensee's application for the proposed

822dealership, such dealer or its predecessor

828made 25 percent of its retail sales of new

837motor vehicles to persons whose registered

843household addresses were located within a

849radius of 12.5 miles of the location of the

858proposed additional or relocated motor

863vehicle dealer; provided such existing

868dealer is located in the same county or any

877county contiguous to the county where the

884additional or relocated dealer is proposed

890to be located.

8935. The licensees in this case are El Sol Trading, Inc.,

904and Fishers Auction Services, Inc., d/b/a Fisher Auto Equipment

913Sales. See §§ 320.60(8) and 320.61, Fla. Stat. (2009).

9226. Respondent is the alleged existing franchised motor

930vehicle dealer. Respondent failed to present any evidence at

939the hearing to establish that it meets the statutory

948requirements to establish standing, by location or sales volume,

957to protest the establishment of the new point franchise motor

967vehicle dealership at issue in this case.

974RECOMMENDATION

975Based on the foregoing Findings of Fact and Conclusions of

985Law, it is RECOMMENDED that the Department enter a final order

996dismissing the protest filed in this case by Cycles and More,

1007Inc., and granting Petitioners' request to establish a new point

1017franchise motor vehicle dealership for the sale of SHEN

1026motorcycles.
