169A. Did Nature Coast demonstrate special circumstances to

177justify approval of its Certificate of Need (CON) application to

187establish a n ew hospice program in Service Area 3D, Hernando

198County, in the absence of published numeric need?

206B. If Nature Coast demonstrated special circumstances to

214justify approval, does Nature Coast's proposal satisfy the

222requirements of Florida Administrative Co de Rule 59C - 1.0355, and

239PRELIMINARY STATEMENT

241On September 27, 2013, the Agency published a zero fixed

251need pool for hospices in Hernando County, for the applicable

261planning horizon. On November 13, 2013, Nature Coast filed its

271CON Application No. 10204 seeking to establish a new hospice

281program in H ernando County. The application relied upon the

291theory that "special circumstances," as provided in r ule 59C -

3021.0355(4)(d), supported approval of a program, in the absence of

312fixed need. The factors relied upon were an underserved need for

323pediatric palli ative care in Hernando County with a related need

334for services through Children's Medical Services Partners in

342Care/Together for Kids program (PIC:TFK) and a lack of access to

353hospice care for rural residents.

358AHCA preliminarily granted the application in its State

366Agency Action Report (SAAR) issued February 14, 2014. Hernando -

376Pasco filed a petition challenging the granting of Nature Coast's

386CON application. On March 24, 2014, AHCA referred the petition

396to DOAH. On April 7, 2014, DOAH set the matter for final hearing

409to be held July 21 through 25, 2014, dates suggested by all

421parties in their Joint Response to Initial Order.

429On May 20, 2014, Nature Coast filed a Motion for Continuance

440of the hearing until December 2014, based upon the assertion that

451its health planning witness, Kathy Platt, was "unavailable during

460the scheduled final hearing dates due to a final hearing for a

472certificate of need matter in Georgia." Ms. Platt was also the

483CON application's primary author. The undersigned denied the

491moti on because the motion did not identify the Georgia case,

502state when the Georgia hearing was scheduled, or describe any

512efforts to resolve the asserted schedule conflict. Fla. Admin

521Code R. 28 - 106.210 (requiring good cause for a continuance). The

533order de nying the motion, however, allowed presentation of the

543witness's testimony out of order or by deposition. Nature Coast

553chose to engage another expert. The final hearing convened as

563scheduled.

564Nature Coast presented the testimony of Marylin Bloom;

572Jenni fer Lawson; Linda Martin, R. N.; Suzanne Worsham; Bonnie

582Saylor; David Levitt; and Armand E. Balsano. Nature Coast

591Exhibits 1 through 24, 27 through 29, 31, 34 through 60, 64

603through 67, 75, 76, 78 through 80, and 117 through 122 were

615admitted into evidence.

618The Agency presented the testimony of Jeffrey N. Gregg by

628deposition transcript, admitted as Agency Exhibit 2. The Agency

765FINDINGS OF FACT

768I. The Parties

771A. The Agency

7741. The Agency is the single state agency responsible for

784the administration of Florida's CON Program. § 408.031, Fla.

793Stat.

7942. The Agency is designated both "as the state health

804planning agency for purposes of federal law . . . [and as] the

817single state agency to issue, revoke, or deny certificates of

827need . . . in accordance with present and future federal and

839state statutes." § 408.034(1), Fla. Stat.

845B. Nature Coast

8483. Nature Coast is a non - profit, charitable organization

858that provides hospice services in Service Areas 3A and 3C.

868Citrus County makes up Serv ice Area 3C. Service Area 3A consists

880of 11 counties in north central Florida stretching all the way to

892the Georgia border. They are: Alachua, Bradford, Columbia,

900Dixie, Gilchrist, Hamilton, Lafayette, Levy, Putnam, Suwanee, and

908Union Counties.

9104. Nature Coast provides hospice services, medical,

917psychological, spiritual, and social support to people with

925terminal illness at the end of life. It provides grief services

936to families and survivors during hospice care and for at least 13

948months after wards. Nature Coast also provides grief counseling

957services to anyone in its area who has experienced the death of

969someone close to them. Grief counseling can be individualized,

978group, by telephone, or mail support and is provided for as long

990as needed. Nature Coast also offers social support services to

1000individuals to re - integrate them back into society.

10095. Nature Coast utilizes its hospice house, nursing homes

1018with inpatient contracts, the hospice unit at a hospital, or

1028continuous care at a patient's home when a patient's symptoms are

1039out of control or there is not adequate care given at home. It

1052also provides respite care.

10566. Nature Coast operates seven thrift and gift shops. In

1066addition to raising money, the shops offer employees, volunteers,

1075and shoppers a place to talk about hospice. The shops are also

1087an avenue for grief support. They offer a place for caregivers

1098who would like to help out a chance to give back.

11097. Nature Coast offers numerous community programs,

1116including youth programs, ber eavement programs, education, and

1124outreach.

11258. All Nature Coast employees and contracted staff must

1134meet required training and education standards. They must have

1143demonstrated competencies, evaluations, and training. Employees

1149and contracted staff alike can be reprimanded, written up, and

1159retrained if they are not performing as expected by Nature Coast.

11709. Nature Coast operates a 16 - bed inpatient facility in

1181Lecanto, Citrus County, Florida. Nature Coast sometimes uses

1189these beds as residential beds. N ature Coast also operates an

1200inpatient unit at Citrus Memorial Hospital. Nature Coast has

1209eight satellite offices located throughout Service Areas 3A and

12183C. It has approximately 475 employees, about 200 staff working

1228as needed, about 200 contract staff, and 600 volunteers.

123710. Nature Coast serves patients in home, any facility

1246setting, or inpatient facility. Home could be a patient's home,

1256a caregiver's home, a group home, an ARC residential facility, or

1267a tent in a backyard. Nature Coast also serves homeless persons

1278wherever they choose to be served. Nature Coast will assist a

1289homeless person with finding a residence, if asked.

129711. Nature Coast has been Joint Commission accredited since

13062007. The Joint Commission audits Nature Coast. The Commiss ion

1316has never found Nature Coast out of compliance with quality of

1327care or Medicare Conditions of Participation.

133312. The Hospice Provider Family Survey rating for Nature

1342Coast is five stars. According to the Department of Elder

1352Affairs ("DOEA") Hospice O utcomes Measures Report for calendar

1363year 2012, Nature Coast exceeded the state average for outcomes.

137313. Nature Coast is accredited by the Jewish Institute and

1383also provides specialized services for veterans.

138914. Nature Coast has specialized services f or pediatric

1398patients and provides services to children enrolled in the

1407Children's Medical Services (CMS) PIC:TFK program.

141315. Nature Coast took over the PIC:TFK program in the CMS -

1425Alachua service district, at the request of CMS, because the

1435existing prov ider abandoned the program due to cost and required

1446labor. In 2009, federal laws changed, allowing the PIC:TFK

1455program to go statewide. This allowed Nature Coast to provide

1465PIC:TFK services in all 11 counties of Service Area 3A.

147516. In 2010, Nature Coas t became a PIC:TFK provider in

1486Citrus County, which is included in the CMS - Ocala service

1497district. At the request of CMS - Ocala, Nature Coast began

1508serving a few PIC:TFK patients in Hernando County in 2012.

1518Nature Coast incorrectly believed that, similar to the operation

1527of its agreement with CMS - Alachua, which allowed Nature Coast to

1539serve multiple counties, its agreement with CMS - Ocala allowed it

1550to serve PIC:TFK patients in Hernando County.

155717. Nature Coast provides quality care to its patients. If

1567Na ture Coast begins operation in Hernando County, it will provide

1578quality care to the patients served there.

1585C. Hernando - Pasco

158918. Hernando - Pasco began operating in Pasco and Hernando

1599counties in 1984. It currently serves Citrus, Pasco and Hernando

1609coun ties. Hernando - Pasco operates three care centers in Pasco

1620County. Hernando County's care center was once located in the

1630city limits of Brooksville. But Hernando - Pasco relocated it

1640towards the Suncoast Parkway nearer the center of the population.

1650The car e centers are inpatient units, built similar to a nursing

1662home.

166319. Hernando - Pasco serves everyone who is appropriate for

1673hospice. It serves patients wherever they may live, i.e., homes,

1683nursing homes, ALFs, rural areas. It provides interpreters for

1692non - English speaking and deaf patients and families.

170120. Hernando - Pasco provides a full range of core services

1712including nursing, social work, physician, dietary counseling,

1719bereavement counseling, and spiritual counseling. It provides

1726inpatient care to qua lified patients. Hernando - Pasco provides

1736bereavement counselors for adults and children.

174221. Hernando - Pasco also offers non - core services, such as,

1754physical and occupational therapy, aide services, home aide

1762services, voluntee rs, medical supplies, and sh ort - term inpatient

1773care. It also has comfort touch, compassionate paws pet therapy,

1783music therapy, and its Legacy Program. And its Children's

1792Assistance Program (CAP) provides community support and both

1800anticipatory grief and bereavement counseling for c hildren. The

1809CAP program holds two types of children's camps every year, which

1820provide therapeutic activities.

182322. Hernando - Pasco has its own pharmacy, durable medical

1833equipment company, and home health agency. It also has a

1843foundation, which is a separ ate not - for - profit entity.

185523. Hernando - Pasco relies on charitable gifts in order to

1866maintain the unreimbursed programs for the community.

1873Approximately 85 percent of the charitable gifts it receives come

1883in the form of memorials, honorariums , and beques ts.

189224. In conjunction with the Veterans Administration and the

1901National Hospice and Palliative Care Organization, Hernando - Pasco

1910operates a program to honor veterans called "We Honor Veterans."

192025. Like Nature Coast, Hernando - Pasco provides its patients

1930quality care. Operation of a new hospice in Hernando County by

1941Nature Coast will not impair Herando - Pasco's ability to provide

1952quality care.

1954II. Overview of Hospice Services

195926. Florida law requires a hospice program to provide a

1969continuum of hospice services and supportive care for terminally

1978ill patients and their families. § 400.609, Fla. Stat. The core

1989hospice services required by Medicare Conditions of Participation

1997include physician, nursing, bereavement, spiritual and social

2004services.

200527. "H ospice care" consists of comprehensive care and

2014services that are not curative in nature, but are provided to

2025persons who are dying. It is defined by proximity to death.

203628. A patient must meet certain state and federal criteria

2046to be admitted to hospice. Florida law defines a terminally - ill

2058patient as a person having a medical prognosis of 12 months or

2070less life expectancy. §§ 400.601(3), (7) and (10), Fla. Stat.

208029. The Medicare hospice benefit requires terminally ill

2088patients to have a life e xpectancy prognosis of six months or

2100less. Like Florida law, the Medicare benefit excludes patients

2109seeking curative treatments from hospice eligibility.

211530. Hospice care is provided pursuant to a plan of care

2126developed by an interdisciplinary team consi sting of physicians,

2135nurses, home health aides, social workers, bereavement

2142counselors, spiritual care counselors, chaplains and others.

214931. There are four levels of service in hospice care:

2159routine home care, general inpatient care, continuous care, and

2168respite care. To qualify for hospice care one must be certified

2179by two physicians as having a terminal illness with less than a

2191six - month prognosis.

219532. Routine home care, provided where the patient resides,

2204is the predominant form of hospice care.

221133. The symptoms managed in general inpatient and in

2220continuous care are the same. But the settings in which patients

2231receive services are different. General in - patient care is

2241provided in either a hospital setting, a dedicated nursing unit,

2251or in a freestan ding hospice inpatient facility. For patients

2261wishing to remain in a home setting such as their home or an

2274assisted living facility (ALF), continuous care is an option to

2284avoid being moved to an inpatient setting.

229134. Hospices provide continuous care, so metimes called

"2299crisis care," in the home or in any setting where the patient

2311resides, including nursing homes and ALFs. Continuous care is

2320provided for short durations when symptoms become so severe that

2330around - the - clock care is necessary for pain and sy mptom

2343management.

234435. Respite care is for caregiver relief. It allows

2353patients to stay in an inpatient setting for brief periods in

2364order to provide caregivers a break.

237036. A hospice cannot provide inpatient care or continuous

2379care simply because a pati ent's family wants to receive the

2390service. State and federal law mandate placing a patient in the

2401correct care setting, with approval by a physician and the

2411interdisciplinary team.

241337. Medicare is the largest payor for hospice services.

2422Other payors incl ude Medicaid, private insurance, managed care

2431plans, and other government payors. Hospices provide some

2439uncompensated care as charity.

244338. A specific philosophy drives hospice care.

2450Consequently, state and federal law require hospice providers to

2459employ all core staff except in times of peak patient loads or in

2472extraordinary circumstances. §400.609(1), Fla. Stat.

247739. Hospice programs are required by law to accept all

2487patients regardless of ability to pay. §400.6095(1), Fla. Stat.

2496III. The Nature Coas t Proposal

250240. Nature Coast proposes to establish a new hospice

2511program in Hernando County.

251541. It will provide the same types of services in Hernando

2526County that it has in Citrus County. It also proposes to

2537specifically focus on the county's rural popu lation, care to

2547persons residing in nursing home and ALF facilities, and to

2557people less than 18 years of age. In its application, its

2568evidence, and the Joint Proposed Recommended Order, Nature Coast

2577identified the special circumstances supporting approval of its

2585application despite the absence of a calculated need as "lack of

2596service to children enrolled in the PIC:TFK program and rural

2606patients not being served at home." (Joint PRO at ¶ 49) Nature

2618Coast and the Agency also emphasize that since Hernando - Pasco is

2630the sole provider in the county, Nature Coast's hospice would

2640provide choice and competition to Hernando County residents.

264842. The residents include non - hospice patients enrolled in

2658PIK:TIF which will be discussed in more detail later. Nature

2668Co ast will also meet other needs of the Hernando County community

2680as they are identified.

268443. Nature Coast would operate its proposed program as a

2694satellite out of Nature Coast's Lecanto home office in Citrus

2704County. If approved, Nature Coast would offer t he same services

2715that Hernando - Pasco currently provides in Hernando County,

2724participate in PIC:TKF, and emphasize services to patients under

2733the age of 18.

273744. Nature Coast will be able to use its existing

2747infrastructure to support the new hospice program . Additionally,

2756it will be able to share staffing from nearby offices such as

2768those in Inverness and Homosassa.

277345. Nature Coast has not chosen the location for its

2783Hernando offices. It has looked at leasing space in the central

2794eastern portion of Herna ndo County, near the intersection of

2804Highways 41 and 50 in Brooksville. The Agency and Nature Coast

2815do not propose a location as a CON condition.

282446. Nature Coast plans to conduct only one fundraising

2833event in Hernando County. That is its holiday season Tree of

2844Remembrance.

284547. Nature Coast will not solicit donations from families

2854of Hernando County patients. It is typical, however, for friends

2864and family of patients to contribute to a hospice, if pleased

2875with the care provided. Consequently, it is re asonable to infer

2886that a family using Nature Coast for its hospice needs would be

2898unlikely to make a donation or memorial gift to Hernando - Pasco

2910and vice versa.

291348. Nature Coast will meet the needs of low income patients

2924and residents through its Indigent /Charity Care Policy.

293249. The Agency and Nature Coast propose to condition

2941approval of the CON application on the following: (a) Nature

2951Coast will participate in the PIC:TFK program for Hernando County

2961patients and the provision of hospice services to PI C:TFK

2971patients that become hospice eligible; (b) Nature Coast will

2980provide community outreach and education and grief support

2988programs; and (c) Nature Coast will offer alternative therapies

2997to patients, that may include massage therapy, music therapy,

3006play therapy and holistic (non - drug) therapy.

301450. State and federal law require hospice programs to

3023provide services to anyone eligible who requests them.

3031Therefore, the Agency will not place conditions on the program to

3042provide legally required services.

304651 . There is nothing especially remarkable or unusual about

3056Nature Coast's proposed conditions.

306052. There is also nothing special or unique about Nature

3070Coast's volunteer program or materials. Every hospice is

3078required by federal law to have a volunteer p rogram.

3088IV. Overview of Partners - in - Care:Together - for - Kids

310053. PIC:TFK is a 1915(b) Medicaid waiver program operated

3109under the authority of Children's Medical Services, Florida's

3117Title V Program for Children with Special Health Care Needs.

3127Funding is through Medicaid, Florida Kid Care, Title XIX (Pedi -

3138Care), and some private insurance. Some children are uninsured.

3147Eligible families have either Medicaid or Title XIX and are on

3158the lower income scale. Children who receive PIC:TFK services

3167are very, ve ry sick. Their parents are often social - economically

3179challenged.

318054. The federal government created the PIC:TFK program

3188several years ago. It is designed to extend the normal life

3199expectancy for children in hopes doctors and families would refer

3209childre n and a relationship would be established. Then if a

3220child becomes hospice appropriate, it would be easier for doctors

3230and families to segue from curative care to hospice care.

324055. Only hospices can be a PIC:TFK partner or provider.

325056. Referrals for PI C:TFK come from CMS nurses' caseloads.

3260Each CMS nurse serves between 200 - 300 patients. CMS Care

3271coordinators identify eligible children and enroll them in

3279PIC:TFK. Once enrolled a child receives home and community - based

3290palliative services provided by h ospice staff specially trained

3299in pediatric palliative care. These services are based on the

3311individual child and family's care plan, which is regularly

3320assessed and updated.

332357. A child must have a life - limiting illness to enroll in

3336PIC:TFK. Children ÏÏ birth through age 21 ÏÏ enrolled with

3346Children's Medical Services may qualify for PIC:TFK at any stage

3356of their life - limiting illness.

336258. The primary physician must attest to the life - limiting

3373illness in writing. Life - limiting diagnoses include, but are n ot

3385limited to: cancer, cerebral palsy, cystic fibrosis, traumatic

3393brain injuries, severe motor vehicle accidents, and chromosomal

3401abnormalities.

340259. Children and their families can receive palliative care

3411such as pain management, symptom management, pati ent and family

3421counseling, expressive therapies, including play, music or art

3429therapy, psychosocial and spiritual therapy, respite care,

3436volunteer services and bereavement, including anticipatory grief

3443services, concurrently with curative treatment through the

3450PIC:TFK program.

345260. PIC:TFK is a psychological - social program. It provides

3462understanding of medications, complexity of issues, and helps

3470with the grieving process. PIC:TFK gives parents a person to

3480talk to who understands the unique challenges and sorrow of a

3491mortally ill child.

349461. Under PIC:TFK, the hospice physician is charged with

3503contacting and staying in touch with the primary care physician.

3513The primary care physician is the gate keeper and is responsible

3524for following a child enrolled in PIC:TFK: prescribing

3532medications, ordering durable medical equipment, ordering home

3539care. The primary care physician will receive copies of all

3549correspondence, updated plans of care, admitting plans of care,

3558and discharge from PIC:TFK.

356262. CMS nurses le t families know about PIC:TFK services

3572offered by a hospice. A service isn't offered unless agreed to

3583by CMS.

358563. The PIC:TFK provider goes into the child's home,

3594assesses the child's needs, and guides the family toward

3603appropriate services and resources . The PIC:TFK provider can

3612provide respite care to the family, and can offer nursing care,

3623social workers, in - home medical support for pain management and

3634symptom management, in - home personal care, and in - home spiritual

3646care.

364764. PIC:TFK patients are a subset of patients that could

3657become hospice patients.

3660V. Fixed Need Pool

366465. The Agency's r ule 59C - 1.0355 establishes a hospice

3675numeric need formula for publication of a Fixed Need Pool (FNP)

3686for each hospice Service Area in each CON batching cycle.

36966 6. The formula takes into account historic and projected

3706deaths in each service area for a particular planning horizon, as

3717well as the historic and projected number of hospice admissions

3727within the service area in four specific categories of patients:

3737ca ncer age 65 and over; noncancer age 65 and over; cancer under

3750age 65; and noncancer under age 65.

375767. Under the numeric need formula, if the number of

3767projected admissions to hospice in the planning year using a

3777statewide average penetration rate applie d to the four specific

3787patient categories is at least 350 more than the current number

3798of hospice admissions in the service area, there is a numeric

3809need for another hospice provider in the service area.

381868. In the batch here, there was not a numeric ne ed. The

3831formula projected 254 additional hospice admissions in Hernando

3839County in the October 2013 projections governing this batch.

3848After Nature Coast submitted its application, that number

3856declined to 155.

385969. However, Hernando County's population i s growing,

3867including its elderly and pediatric populations.

3873VI. Special Circumstances

387670. Since the Agency did not project a need for a new

3888hospice, Nature Coast relied on the argument that special

3897circumstances supported approving its application. Rul e 59C -

39061.0355(4)(d) establishes the standards for a special circumstance

3914need.

391571. It provides:

3918(d) Approval Under Special Circumstances.

3923In the absence of numeric need identified in

3931paragraph (4)(a), the applicant must

3936demonstrate that circumstances exist to

3941justify the approval of a new hospice.

3948Evidence submitted by the applicant must

3954document one or more of the following:

39611. That a specific terminally ill population

3968is not being served.

39722. That a county or counties within the

3980service area of a licensed hospice program

3987are not being served.

399172. There are no counties within Nature Coast's proposed

4000service area that are not being served by a hospice.

401073. Consequently Treasure Coast and the Agency must prove

4019that a specific terminally ill popul ation is not being served.

4030The population that they contend is not being served are eligible

4041PIC:TFK patients and terminally ill patients under the age of 18.

405274. The parties and witnesses presented different data and

4061theories about terminally ill pati ents under 18 in need of

4072hospice services. The data and theories agree that the number of

4083these patients is small, by any measure. The data and theories

4094presented as evidence are simply inconclusive about whether the

4103absence of reported hospice utilizati on by young patients in

4113Hernando County is because the patients are not being served or

4124because there have not been any patients in recent years.

413475. The data is clear, however, that residents of Hernando

4144County include some undetermined and small number of terminally

4153ill patients under the age of 18 and patients under the age of 18

4167who may become terminally ill. The admission by Herando - Pasco in

41792011 of four patients under the age of 18 and in 2013 of seven

4193patients under the age of 18 shows that. The fact that Hernando -

4206Pasco admitted no patients under the age of 18 in 2013

4217exemplifies the unpredictable nature of these admissions.

422476. The record is also clear that Hernando County, at the

4235time that the Agency issued its decision, did not have a PIC:TFK

4247provider and that only hospices may be providers. After the

4257decision on June 14, 2014, Hernando - Pasco entered a PIC:TFK

4268agreement with CMS.

427177. The Agency, applying its expertise and in fulfillment

4280of its legislative charge to administer the CON prog ram and

4291conduct health care planning for the state, has concluded that

4301terminally ill patients under the age of 18 and patients under

4312the age of 18 who may become terminally ill should have access to

4325PIC:TIF services. Approval of Nature Coast's CON applic ation

4334will provide that service to the population of Hernando County.

4344In fact, it is reasonable to infer that preliminary approval of

4355the application motivated to Hernando - Pasco to contract with CMS.

436678. The Agency and Nature Coast maintain, albeit half -

4376heartedly, that the rural population of Hernando County does not

4386have access to hospice services. The credible persuasive

4394evidence does not demonstrate that an identifiable rural

4402population of Hernando County lacks access to hospice services.

4411VII. Othe r Applicable Disputed Criteria

4417A. Section 408.035(1)(b), Florida Statutes Ï

4423availability, quality of care, accessibility and extent

4430of utilization

443279. Hernando - Pasco provides high quality of hospice care to

4443Hernando County residents. Its services are accessible and

4451adequately utilized.

445380. It s eeks to serve everyone that is appropriate for

4464hospice care, including but not limited to: patients who are

4474homeless; children; persons with HIV, AIDS, Alzheimer's or

4482dementia; minority and ethnic groups; an d persons residing in

4492rural Hernando County.

449581. It also offers staff and volunteers who speak languages

4505other than English, when needed, to assist patients and their

4515families.

451682. The hospice service penetration rate for Hernando - Pasco

4526County is 65 pe rcent, just below the state average of 66 percent.

453983. Credible persuasive evidence did not establish that

4547Hernando - Pasco has refused services to eligible patients.

4556B. Section 408.035(1)(c) Ï The ability of the

4564applicant to provide quality of care and the

4572applicant's record of providing quality of care.

457984. The weight of the credible, persuasive evidence,

4587including the private accreditations of Nature Coast and its

4596ratings, establish a record of providing quality care and that it

4607would provide qualit y care in Hernando County.

461585. This is despite the fact that in 2012 an Agency survey

4627identified six patients who did not meet the criteria for hospice

4638care or criticisms in that survey of Nature Coast providing

4648services, mostly PIC:TFK services, to resi dents of Hernando

4657County. In addition, since PIC:TFK services are not available in

4667Hernando County, approval of this application will alleviate that

4676problem.

467786. It is also despite the fact that in 2013 Nature Coast

4689spent approximately 12 percent of its labor expenses on contract

4699staff. That fact may be a licensure or reimbursement issue. But

4710the record does not establish that it affects the quality of care

4722Nature Coast provides.

4725C. Section 408.035(1)(d), Florida Statutes Ï

4731availability of resources, including health personnel,

4737management personnel and funds for project

4743accomplishment and operation

474687. Nature Coast will be able to recruit and employ the

4757health and management personnel for its project. The fact that

4767it bases its projections upon its actual experience in the

4777adjoining area is more persuasive than criticisms that its

4786proposed salaries are lower than those paid by Hernando - Pasco.

479788. Additionally the ability to share support, resources,

4805and infrastructure from Nature Coast's existing operations

4812provides it the resources and flexibility to adjust to

4821fluctuations or shortfalls in utilization or income. The

4829existing infrastructure can support the additional team required

4837by opening the proposed Hernando County Hospice.

484489. This is in a ddition to the flexibility and benefits

4855provided by the fact that providing hospice services does not

4865require large capital commitments and that most of its costs are

4876therefore variable costs. One example of this is that staffing

4886is incremental, increasin g or decreasing, according to the demand

4896created by utilization.

489990. The estimated project costs of $1,059,000 are

4909reasonable. Nature Coast could fund the costs from existing

4918liquid assets. It also has the working capital needed available.

492891. The ap plication did not disclose the now completed

4938closing on an $800,000 office building in Palatka or a $1.2

4950million building project underway when the application was filed.

4959The persuasive competent evidence proves that despite the absence

4968of that informatio n from the presentation in the application,

4978Nature Coast will none - the - less have access to the resources

4991necessary to establish the project. The credible, persuasive

4999evidence also proves that the smaller expense was not in the

5010period covered by the applic ation and the majority of the bigger

5022amount had been expended before submission of the application.

503192. In March 2014, the Office of the Inspector General

5041served Nature Coast with a subpoena, seeking certain documents

5050for the period 2009 through 2013. In response, Nature Coast

5060turned over 188,000 pages of medical records. Being subject to a

5072lengthy federal investigation is unpredictable and may be both

5081time consuming and costly. As a result of the ongoing

5091investigation, Nature Coast recently prudentl y established a $2.5

5100million line of credit to cover possible costs of repayment and

5111fines. There is no way at this point to reasonably project the

5123timing or the impact of fines or repayments, if any, resulting

5134from the investigation. Consequently not in cluding them in the

5144financial projections for the first two years of operation was

5154reasonable.

515593. The weight of the credible persuasive evidence

5163established that Nature Coast has access to sufficient resources,

5172including health personnel and funds, for accomplishing and

5180operating the proposed Hernando County hospice.

5186D. Section 408.035(1)(e), Florida Statutes Ï extent to

5194which the proposed services will enhance access to

5202health care for residents of the service district

521094. As discussed above, Nature Coast's proposed hospice

5218will enhance access to PIK:TIF services. And it will enhance

5228those patients' access to continuity of care in the event that

5239they need hospice services. Nature Coast will enhance choice for

5249hospice patients; but it will not enhan ce access to hospice

5260services.

5261E. Section 408.035(1)(f), Florida Statutes Ï immediate

5268and long - term financial feasibility

5274(i) Immediate Financial Feasibility

527895. Findings of Fact 88 through 93 address the issue of

5289immediate or short - term financial feasibility. Nature Coast

5298established by competent substantial evidence that it is

5306financially feasible in the short - term.

5313(ii) Long - term Financial Feasibility

531996. An applicant's pro forma financial projections are

5327primarily determined by estimating the revenues and expenses

5335associated with the projected utilization (in patient days), by

5344payor source, for years one and two. Nature Coast's projection

5354is unreason ably optimistic. It is not likely to capture the 243

5366and 413 admissions projected respectively for years one and two.

5376Several factors support this finding including Nature Coasts

5384start up experience in other markets, the lack of a basis for the

5397size of i ts market share projections, and the absence from the

5409record of a credible basis for the utilization projections.

541897. Also, in order to meet Nature Coast's projected

5427admissions in year one, it will have to match the highest market

5439share penetration of the 18 startups in the past 10 years, and in

5452the second year will have to surpass the highest market share

5463penetration rate of that same group. There is no evidence

5473suggesting why that would happen.

547898. The record does not establish a credible "break ev en"

5489point for the proposal that would allow an evaluation of whether

5500or at what point the project would be feasible with lower,

5511realistic utilization projections.

551499. Revenue and cost projections are based upon

5522utilization. Without credible utilizatio n projections, the

5529record d oes not establish that the long - term financial

5540projections are reasonable.

5543F. Section 408.035(1)(g) Florida Statutes Ï extent to which

5552the proposal will foster competition that promotes quality

5560and cost effectiveness

5563100. T he addition of any provider will foster competition.

5573But, with the exception of PIK:TFK services, there is nothing

5583about Nature Coast's proposal that would foster competition other

5592than as a new provider always would.

5599VII I . Standing

5603101. The Agency an d Nature Coast include an argument in

5614their Proposed Recommended Order that Hernando - Pasco does not

5624have standing to bring this proceeding. The parties did not

5634identify s tanding as an issue in the Pre - h earing Stipulation or

5648at any time in this proceeding. It is waived and may not be

5661raised at this late date.

5666CONCLUSIONS OF LAW

5669A. Jurisdiction

5671102. DOAH has jurisdiction over the parties to and the

5681subject matter of this proceeding. §§ 120.569, 120.57(1), and

5690408.039(5).

5691B. Burden of Proof

5695103. As the applicant, Nature Coast bears the burden of

5705proving entitlement to a CON by the preponderance of the

5715evidence. Boca Raton Artificial Kidney Ctr., Inc. v. Dep't of

5725HRS , 475 So. 2d 260 (Fla . 1st DCA 1985); § 120.57(1)(j).

5737C. Balancing of Criteria

5741104. T he award of a CON to an applicant must be based on a

5756balanced consideration of all applicable and statutory rule

5764criteria. Balsam v. Dep't of HRS , 486 So. 2d 1341 (Fla. 1st DCA

57771986). "[T]he appropriate weight to be given to each individual

5787criterion is not fixed, but, rather must vary on a case - by - case

5802basis, depending upon the facts of each case." Collier Med.

5812Ctr., Inc. v. Dep't of HRS , 462 So. 2d 83, 84 (Fla. 1st DCA

58261985).

5827105. An administrative hearing involving disputed issues of

5835material fact is a de novo proceeding, in which the

5845Administrative Law Judge independently evaluates the evidence

5852presented. Fla. Dep't of Transp. v. J.W.C. Co., Inc. , 396 So. 2d

5864778, 787 (Fla. 1st DCA 1981); § 120.57(1), Fla. Stat. (2011).

5875AHCA's preliminary decisions on CON applications, including its

5883findings in the SAAR, are not entitled to a presumption of

5894correctness. Id.

5896106. The Agency's fixed need pool was zero. This means

5906that Natur e Coast's CON will not be approved, unless it

5917establishes "special circumstances" that support approval despite

5924the absence of published need. Fla. Admin. Code R. 59C -

59351.0355(4)(b), (c), and (d).

5939E. Special Circumstance s

5943107. Rule 59C - 1.0355(4)(d) is t he "special circumstances"

5953provision. It provides:

5956Approval Under Special Circumstances. In the

5962absence of numeric need identified in

5968paragraph (4)(a), the applicant must

5973demonstrate that circumstances exist to

5978justify the approval of a new hospice.

5985Evidence submitted by the applicant must

5991document one or more of the following:

59981. That a specific terminally ill population

6005is not being served.

60092. That a county or counties within the

6017service area of a licensed hospice program

6024are not being served.

6028108. The findings of fact establish that patients under the

6038age of 18, including some number of terminally ill patients, in

6049Hernando County are not receiving PIC:TFK services. The Agency

6058maintains that the reference to population "not being served"

6067inclu des a population that is not receiving a service that can

6079only be provided by a hospice. The Agency's interpretation of

6089its rule has not been shown unreasonable and therefore merits

6099deference. Verizon Fla., Inc. v. Jacobs , 810 So. 2d 906, 908

6110(Fla. 2002) ; Fla. Wildlife Fed'n v. Collier Cnty. , 819 So. 2d 200

6122(Fla. 1st DCA 2002); D.A.B. Constructors, Inc. v. State of Fla.

6133Dep't of Transp. , 656 So. 2d 940 (Fla. 1st DCA 1995). It is also

6147supported by the fact that only hospice providers can provide

6157PIC:TFK s ervices which would make them a service of a hospice.

6169F. Weighing Other Criteria

6173109. The absence of credible utilization projections

6180fatally flaws consideration of two critical criteria. Without

6188credible ut ilization projections, the long - term financial

6197reasonableness was not established. Without credible utilization

6204projections, the staffing projections cannot be meaningfully

6211evaluated. These two projections are central to determining if

6220the project should be approved. Since the record does not

6230estab lish them, this failure outweighs the benefit of providing

6240PIC:TFK services.

6242RECOMMENDATION

6243Based upon the foregoing findings of fact and conclusions of

6253law, it is RECOMMENDED that the Agency for Health Care

6263Administration issue a Final Order denying Certi ficate of Need

6273Application Number 10204 of Hospice of Nature Coast County, Inc.,

6283d/b/a Hospice of Nature Coast and the Nature Coast.
