113As addressed in an order dated January 2, 1992, an evidentiary motion

125hearing was conducted, by telephone, on a motion to dismiss Central Florida

137Wetlands Society's petition in case number 91-6871, styled above.

146Consistent with that order, the parties have filed affidavits and briefs or

158memoranda on their respective positions. In addition, the City of Orlando and

170Kirkman Orlando Partners, LP ( KOP) have submitted supplemental affidavits.

180These have been considered in the preparation of this order, and the motions to

194strike supplemental affidavits by City of Orlando and KOP are each DENIED.

206ISSUES

207The issue for disposition is whether Central Florida Wetlands Society's

217petition in case number 91-6871 should be dismissed as requested by Kirkman

229Orlando Partners, LP ( KOP). More specifically, it must be determined whether

241the Heritage Florida Jewish News is a "newspaper of general circulation", and,

253if so, whether any circumstances exist that would excuse the Society's failure

265to file its petition within the 21-day period specified in a notice published in

279that newspaper.

281BACKGROUND MATTERS

283As stipulated by the parties, the evidence in this proceeding has been

295presented primarily by affidavits. Michael Mingea testified on behalf of the

306Central Florida Wetlands Society, but his testimony was generally argument with

317regard to the Society's position and restatements of matters presented in his

329petition and letters. His testimony has been considered, with the affidavits

340filed by the remaining parties and his letters, furnished to the other parties,

353have been considered with the remaining parties' briefs and memoranda.

363A separate order is being entered this same day with regard to the City of

378Orlando's motion for extension of time to file petition and Kirkman Orlando

390Partners LP's motion to dismiss or strike, in DOAH case number 91-8017.

402FINDINGS OF FACT

4051. On September 13, 1991, Kirkman Orlando Partners LP ( KOP) and the

418Florida Department of Environmental Regulation ( DER) entered into a consent

429order with regard to an enforcement action by the agency involving dredging and

442filling of wetlands in Orlando, Orange County, Florida.

4502. The consent order includes this requirement:

45714. Respondent shall publish the following

463notice in a newspaper of general circulation

470in Orange County, Florida. The notice shall

477be published one time only within 10 days

485after execution of the Consent Order by the

493Department.

639The Petition must contain the information set

1066prescribed by law, with the District Court of

1088where the party resides. The Notice of Appeal

1096must be filed within 30 days of rendition of

1105the Order to be reviewed.

1110Respondent shall provide proof of

11333. The required notice was published in the September 20, 1991 edition of

1146Heritage Florida Jewish News (Heritage).

1151The filing deadline was, therefore, Friday, October 11, 1991, 21 days after

1163the notice was published. As reflected above, the notice clearly provides that

1175filing means "received" by the agency and that failure to file constitutes a

1188waiver of right to an administrative hearing.

11954. On September 25, 1991, Doug MacLaughlin, Esquire, Counsel for DER, sent

1207a letter to Randall Denker, Esquire stating:

1214Enclosed as you requested is a copy of the

1223Consent Order as referenced above. Also

1229enclosed is a copy of the public notice

1237published on September 20, 1991, in the

1244Heritage Florida Jewish News, also enclosed.

1250Note that the published public notice

1256allows affected parties 21 days from September

126320 to petition for a hearing. Assuming that

1271this is considered adequate public notice,

1277this 21 day newspaper deadline would apply to

1285any of your clients interested in this matter.

1298Ms. Denker represents Central Florida Wetlands Society ( CFWS) in a civil

1310proceeding related to the activities that are the subject of the consent order.

1323CFWS received actual notice of the proposed agency action. As stated in

1335Michael Mingea's letter to the hearing officer filed at DOAH on January 6, 1992:

1349...[W]e feel the decision regarding your

1355ruling on the acceptability of the Heritage

1362Jewish News is unnecessary because the Society

1369received actual notice of proposed agency

1375action from DER's attorney, Mr. MacLaughlin,

1381stating that we had a certain number of days

1390to submit a Petition for an Administrative

1397Hearing and we submitted a Petition within

1404that time-frame. Therefore, we feel that

1410DER's letter of actual notice supersedes any

1417published notice in the Heritage Jewish News.

14245. A petition for formal administrative proceeding, signed and verified by

1435Michael Mingea, President, CFWS, was filed (received) by the DER Office of

1447General Counsel on October 14, 1991.

14536. The City of Orlando filed a motion for extension of time to file

1467petition on November 12, 1991.

14727. DER's Central District Office in Orlando, the office responsible for

1483administration of the consent order, has taken the position that Heritage is not

1496a newspaper of general circulation. George Gionis, Program Administrator for

1506the Water Management Division in DER's Central District Office has informed KOP

1518of his concern, but no one from DER has insisted or suggested that the notice

1533should be republished in another newspaper in order to comply with the consent

1546order.

15478. The Heritage has been published weekly for more than 15 years on a

1561continuous basis. It has a circulation of approximately 3000 on a regular

1573basis, up to approximately 7000 for certain issues. The population of Orange

1585County is approximately 701,000.

1590The newspaper is entered as second class mailing at the post offices in

1603both Orange and Seminole Counties.

1608It contains at least 25% of its words in the English language. The four

1622issues filed at the Division of Administrative Hearings, and included as

1633evidence in this proceeding, are dated February 1, 1991; May 10, 1991; June 21,

16471991; and September 20, 1991. All of the words in those issues are in English.

16629. Substantially less than 50% of the newspaper is devoted to classified

1674advertisements. The classifieds include legal notices from the Ninth (Orange

1684County) and Eighteenth ( Seminole County) Judicial Circuits. Legal notices by

1695the Florida Department of Professional Regulation ( DPR) are also found in the

1708classified section. (See February 1, 1991 edition containing notices of action

1719by DPR's Board of Funeral Directors and Embalmers, Board of Construction, and

1731Board of Cosmetology.)

173410. Even though the newspaper is not sold at any of the three newsstands

1748listed in the yellow pages of the Orlando telephone book, it is offered for sale

1763to the public generally. The newspaper is available for purchase by the public

1776through subscription and at the Jewish Community Center in Maitland and the

1788newspaper office in Fern Park. It is available to the public at the Orlando and

1803Maitland public libraries.

1806The newspaper's masthead recites:

1810HERITAGE Florida Jewish News

1814( ISN 0199-0721) is published weekly for $22.26

1822($21 plus $1.26 Fla. sales tax) per year to

1831Florida addresses ($25 for the rest of the

1839U.S.) by HERITAGE Central Florida Jewish News,

1846Inc., 207 O'Brien Road, Suite 101, Fern Park,

1854FL 32730. Second-class postage paid at Fern

1861Park and additional mailing offices.

186611. The Heritage customarily contains information of a public character or

1877of interest or value to the general public and residents and property owners in

1891Orange and Seminole Counties.

1895The four editions referenced above include a 12-page fashion section, a 20-

1907page health and fitness section, short articles on central Florida businesses,

1918and articles on elder care and child care. Most of the news articles, local,

1932national and international, relate to Israel or to issues involving Jewish

1943people. For example, the lead headline in the February 1, 1991, edition reads,

"1956Iraqi Missile Attacks have left thousands of Israelis homeless". Another

1967article in that edition reports on U.S. Representative Jim Bacchus' commendation

1978of Israel on the floor of the House. As the attention of the general public was

1994riveted to events in the Persian Gulf in early 1991, it is likely that the same

2010or similar articles appeared in newspapers throughout the state and county.

2021Examples of front page headlines from other editions include, "Israelis

2031racing against the clock to get remaining Jews out of Ethiopia"; "Congress urged

2044to press Syria to let its 4,000 Jews emigrate"; "Federation allocates $81,377 to

2059local agencies from 100 Days Combined Jewish Appeal Campaign"; and "Ethiopians

2070adjust to new lifestyle".

2075CONCLUSIONS OF LAW

207812. The Division of Administrative Hearings has jurisdiction in this

2088proceeding pursuant to Section 120.57(1), F.S.

209413. DER Rule 17-103.150(3), F.A.C. addresses the notice required for

2104proposed agency action other than on a permit application and is relevant

2116here. It provides, in pertinent part:

2122(3) The Department or any person whose

2129substantial interests are or may be affected

2136by proposed agency action other than on a

2144permit application may publish or may be

2151required to publish public notice, and provide

2158proof of publication, in a newspaper of

2165general circulation in the county or counties

2172affected by the proposed action. Such public

2179notice shall contain at least the following

2186information and be in substantially the

2192following form:

2194State of Florida

2197Department of Environmental

2200Regulation

2201Notice of Proposed Agency Action

2206(a) The type of proposed agency action

2213(e.g., Consent Order);

2216(b) A description and location of the

2223subject matter or activity covered by the

2230action, the Department's identification

2234number, and the name and address of any person

2243to whom the action is directed;

2249(c) The location where complete copies of

2256the document and accompanying material

2261expressing the proposed agency action are

2267available for public inspection; and

2272(d) Paragraphs which read substantially as

2278follows:

2279Persons whose substantial interests are

2284affected by the above proposed agency action

2291have a right, pursuant to Section 120.57,

2298F.S., to petition for an administrative

2304determination (hearing) on the proposed

2309action. The petition must contain the

2315information set forth below and must be filed

2323(received) in the Department's Office of

2329General Counsel, 2600 Blair Stone Road,

2335Tallahassee, Florida 32399-2400, within 21

2340days of publication of this notice. A copy

2348of the Petition must also be mailed at the

2357time of filing to the [persons named] above

2365at the address indicated. Failure to file a

2373petition within 21 days constitutes a waiver

2380of any right such person has to an

2388administrative determination (hearing)

2391pursuant to Section 120.57, F.S.

239914. Rule 17-103.150(2)(c), F.A.C. provides, in pertinent part:

2407* * *

2410For the purpose of this rule, "publication in

2418a newspaper of general circulation in the area

2426affected" means publication in a newspaper

2432meeting the requirements of Sections 50.011

2438and 50.031, F.S., in the county where the

2446activity is to take place.

2451* * *

245415. Section 50.011, F.S., requires the following of a newspaper utilized

2465for legal notices or service by publication:

2472a. That it be published and printed weekly or more often;

2483b. That it contain at least 25% of its words in the English language;

2497c. That it be entered or qualified to be admitted and entered as second

2511class matter at a post office in the county where published;

2522d. That it be for sale to the public generally;

2532e. That it be available to the public generally for the publication of

2545official or other notices; and

2550f. That it contain information of a public character or of interest or of

2564value to the residents or owners of property in the county where published, or

2578of interest or of value to the general public.

2587Section 50.031, F.S. imposes the additional requirement that the newspaper

2597at the time of publication of the notice shall have been in existence for one

2612year.

261316. As found in the recitation of facts above, the Heritage Florida Jewish

2626News meets the requirements of Sections 50.011, F.S., and 50.031, F.S., and

2638therefore meets the requirement of DER's rules.

264517. This conclusion is supported by case law exhaustively discussed in

2656Bio-tech Tracking Systems, Inc., v. State of Florida, Department of

2666Environmental Regulation, 13 FALR 2309 (Final Order dated May 17, 1991). In

2678that case, Hearing Officer, P. Michael Ruff found that the Leon County News, a

2692weekly publication printing a mere 100 newspapers a week, available by

2703subscription and at three supermarket newspaper racks in Leon County, was a

2715newspaper of general circulation as provided in DER's Rule and Chapter 50, F.S.,

2728for purposes of publication of a notice of intent to issue a permit for

2742expansion of a biomedical waste incinerator in Leon County.

2751In the face of the Department's exceptions to the recommended order,

2762Secretary Carol Browner adopted the hearing officer's findings of fact and

2773conclusions of law that the Leon County News is a newspaper of general

2786circulation. The Department had argued, as it does here, that the newspaper was

2799not available to the public generally and the intent of Chapters 403 and 120,

2813Florida Statutes could be effectuated only by a broad interpretation of Chapter

282550 to require publication in a widely circulated newspaper.

2834In the absence of a rule or statute, or even case law, the secretary

2848rejected disqualification of a newspaper based on small circulation alone.

2858Notably, the Legislature in 1991 amended the notice provisions for

2868biohazardous waste facilities by defining "newspaper of general circulation" to

2878mean the newspaper in the county with the largest daily circulation. See

2890Section 403.707, F.S. It did not amend Chapter 50, however.

290018. The Department in the instant case argues that not only the

2912circulation but also the content of the Heritage Florida Jewish News should

2924disqualify it. The newspaper, DER claims, is directed essentially to one

2935interest group of the general public.

2941In State ex rel. Miami Leathercote Company v. Gray, 39 So.2d 716, in 1949

2955the Florida Supreme Court found The Jewish Floridian was a newspaper of general

2968circulation in Dade County, stating:

2973* * *

2976We think the rule is settled in this country

2985that while a newspaper may be devoted

2992primarily to the interests of a special class

3000or group, if it contains news of a general

3009character and interest to the community, even

3016though limited but not negligible in amount,

3023it may qualify as a newspaper of general

3031circulation under the law.

3035* * *

3038Several copies of "The Jewish Floridian"

3044are attached to and made a part of the record

3054in this case. They have been examined and we

3063are convinced that much of their contents

3070would be of interest to the general reading

3078public. There is no question that it is

3086essentially a Jewish publication but in most

3093of the communities of our country the

3100interests of Jews and Gentiles so interfuse

3107and overlap that it would be difficult to

3115point out where the interest of one leaves off

3124and the interest of the other takes up. If a

3134distinction like this has any bearing on the

3142case it would be as reasonable to distinguish

3150between the interests of the Scotch and the

3158Irish.

3159* * *

3162Events in the Middle East have made that language all the more relevant

3175today. News affecting or regarding the State of Israel is of far wider interest

3189than solely to persons of the Jewish faith or heritage.

319919. Although no single case in the myriad cases discussed in Bio-tech

3211Tracking Systems, supra, or the parties' memoranda, is precisely on point, this

3223general principle still applies: for more stringent publication requirements to

3233be imposed, specific statutory or regulatory direction must be found.

324320. The Society makes no argument that the deadline should be tolled, but

3256rather claims that its filing within 21 days of actual notice is sufficient.

3269The actual notice it received (the letter to its attorney) also informed it of

3283the running of the deadline from September 20th.

3291DER Rule 17-103.155(3)(a), F.A.C. provides that the running of the time for

3303filing a petition for hearing commences from receipt or publication, (whichever

3314occurs first) of notice of the proposed agency action.

3323Notice to CFWS was unambiguous and clear, and by its failure to timely

3336request an administrative hearing it has waived its right to such hearing.

3348RECOMMENDATION

3349Based on the foregoing, it is hereby

3356RECOMMENDED:

3357That the Department enter its Final Order dismissing the petition of

3368Central Florida Wetlands Society as untimely.
