120The issue is whether the Division of Admi nistrative Hearings

130has subject matter jurisdiction over the issues raised in

139Petitioner's Charge of Discrimination.

143PRELIMINARY STATEMENT

145On or about February 20, 1997, Petitioner Faye Musgrove

154(Petitioner) filed a Charge of Discrimination with the Florida

163Commission on Human Relations (FCHR). Said charge alleged that

172Respondent Suwannee County Sheriff's Department (SCSD)

178discriminated against her in violation of Chapter 760, Florida

187Statutes. Petitioner did not allege that Respondent Suwannee

195County, as a separate governmental unit, was guilty of

204discriminatory acts under Chapter 760, Florida Statutes.

211On August 29, 1997, Petitioner filed an Election of Rights

221Form with FCHR. She sought permission to withdraw her charge and

232to file a Petition for Relief to proceed with an administrative

243hearing pursuant to Sections 760.11(4)(b) and 760.11(8), Florida

251Statutes.

252FCHR referred this case to the Division of Administrative

261Hearings on January 9, 1998. An Amended Initial Order dated

271January 28, 1998, was issued on January 28, 1998.

280The undersigned issued a Notice of Hearing on February 6,

2901998. Said notice scheduled this case for formal hearing on

300June 25-26, 1998.

303On April 8, 1998, SCSD filed the following pleadings:

312Respondent's Motion for Summary Final Order, Respondent's

319Proposed Recommended Order, Petitioner's deposition testimony

325dated February 9, 1998.

329On April 10, 1998, the undersigned issued an Order to Show

340Cause. Said order required Petitioner to show cause why the case

351should not be dismissed for lack of subject matter jurisdiction.

361Petitioner filed a response to the Order to Show Cause on

372August 24, 1998. This order follows.

378FINDINGS OF FACT

3811. Petitioner's discrimination statement dated February 18,

3881997, states as follows:

392I believe that I was discriminated against

399when the sheriff's department used illegally

405obtained information from my employer and a

412relative of mine working in the department,

419to give negative references and information

425to the general public.

4292. Petition er has never applied for employment or been

439employed by the Suwannee County Sheriff or his office.

4483. Petitioner's claim apparently arises out of a family

457dispute between the Petitioner, her mother, Lotis Musgrove, and

466her sister, Eyvonne M. Roberson, who works for the Suwannee

476County Sheriff's Department.

4794. The family dispute is not related to the Petitioner's

489employment with the Suwannee County Sheriff.

495CONCLUSIONS OF LAW

4985. The Division of Administrative Hearings has jurisdiction

506over claims arising under Chapter 760, Florida Statutes.

514Sections 120.57(1) and 760.11, Florida Statutes.

5206. Chapter 760.07, Florida Statutes (1997), provides as

528follows in pertinent part:

532Any violation of any Florida statute making

539unlawful discrimination because of race,

544color, religion, gender, national origin,

549age, handicap, or marital status in the areas

557of education, employment, housing, or public

563accommodations gives rise to a cause of

570action for all relief and damages described

577in s. 760.11(5), unless greater damages are

584expressly provided for. . . .

5907. Claims arising under Chapter 760, Florida Statutes, are

599limited to those which involve discrimination related to

607employment, housing or acquired immune deficiency syndrome

614(AIDS). Honig v. Florida Commission on Human Relations ,

622659 So. 2d 1236, 1237 (Fla. 5th DCA 1995).

6318. Unlawful employment practices are set forth in Section

640760.10, Florida Statutes.

6439. Petitioner has never been an applicant or an employee of

654SCSD. Accordingly, she cannot state a cause of action for

664employment discrimination against SCSD.

66810. Regardless of the harm that the Petitioner may have

678suffered as a result of the family dispute, the Division of

689Administrative Hearings does not have jurisdiction over the

697subject matter of Petitioner's claims pursuant to Chapter 760,

706Florida Statutes.

708RECOMMENDATION

709Based on the foregoing Findings of Facts and Conclusions of

719Law, it is

722RECOMMENDED:

723That FCHR dismiss Petitioner's Petition for Relief.
