111Whether Petitioner qualifies for licensure by examination as

119a psychologist.

121PRELIMINARY STATEMENT

123On June 21, 1995, Respondent, Department of Health, Board of

133Psychology (Department), received an application for licensure as

141a psychologist in Florida from Petitioner, Shirley Czukerberg

149( Czukerberg). On July 19, 1995, Czukerberg was notified that her

160application was incomplete. On June 19, 1997, the Department

169issued a Notice of Intention to Deny Application for Licensure by

180Examination, stating that Czukerberg had failed to demonstrate

188that she possesses a doctoral degree in psychology. Czukerberg

197requested an administrative hearing, and the case was forwarded

206to the Division of Administrative Hearings for assignment to an

216administrative law judge on February 13, 1998.

223At the final hearing Petitioner testified in her own behalf

233and called Donald K. Routh and Paul Greenwald as her witnesses.

244Petitioner's Exhibits 1-16 were submitted in evidence.

251Respondent presented the testimony of Josef Silny and Ivy

260Shivers. Respondent's Exhibits 1-6 were submitted in evidence.

296FINDINGS OF FACT

2991. From 1968 to 1972, Petitioner, Shirley Czukerberg

307( Czukerberg), attended Anahuac University in Mexico City, where

316she studied for the degree of Licentiate in Psychology. She left

327Anahuac University before receiving the degree.

3332. In 1973, Czukerberg received a Bachelor's of Arts degree

343in psychology from New York University in New York.

3523. In 1975, Czukerberg received a Master of Arts degree in

363psychology from New York University.

3684. In 1977, Czukerberg obtained the title of Clinical

377Psychology Specialist by completing a two-year, post-graduate

384program through the University of Costa Rica. In the post-

394graduate program in clinical psychology, students complete

40140 credits of academic coursework and 20 credits of practice and

412training at a hospital.

4165. In 1978, Czukerberg obtained the title of Clinical

425Psychologist from the School of Physicians and Surgeons of Costa

435Rica.

4366. In 1991, Czukerberg published a book in Mexico City

446entitled Polvo de Anos ( Dust of Years ) about the coming of age in

461women.

4627. Czukerberg is highly regarded by the psychiatrist at her

472exempt-setting employment and by others familiar with her work.

4818. On June 21, 1995, Czukerberg submitted an application to

491the Respondent, Department of Health (Agency), formerly Agency

499for Health Care Administration, for psychologist licensure. By

507letter dated July 19, 1995, the Agency advised Czukerberg that

517her application had been received and that she needed to submit

528the following documentation:

531Transcripts for all graduate level coursework

537you completedanscripts must be sent

542directly to our office from the

548university(ies). We have received

552transcripts from:

554Education Coursework Sheet must be completed.

560ADDTIONALLY YOU MUST ATTACH A PHOTOCOPY OF

567THE COURSE DESCRIPTION FOR EACH COURSE.

573COURSE DESCRIPTIONS MUST BE PHOTOCOPIES FROM

579YOUR SCHOOL CATALOG.

582Program analysis form, completed and signed

588by the Chairman of the department in which

596your doctoral program was housed, even if

603your program was approved by the American

610Psychological Association. (from school)

6149. On August 31, 1995, staff of the Agency told Czukerberg

625that her file was still incomplete and that the only transcript

636that had been received was from New York University. Czukerberg

646was also advised that because she was a foreign student that she

658would need to have her educational credentials evaluated by a

668credentialing agency.

67010. On October 9, 1995, the Agency again sent Czukerberg a

681notice that her application was incomplete and that the

690documentation requested must be received by the Agency by

699December 18, 1995, for the April 17, 1996, examination. In

709addition to the information which had been previously requested

718the notice also stated:

722All foreign education must be accompanied by

729a certified English translation. In

734addition, please have a degree equivalency

740determination completed and submitted to this

746office by one of the certified credentialing

753agencies listed in the application previously

759sent to you.

76211. As of November 2, 1995, the Agency had not received the

774additional documentation. Czukerberg was again told that she

782needed to submit the documentation and that she needed to have

793her educational credentials evaluated.

79712. By letter dated January 23, 1996, the Agency sent

807Czukerberg a new application package to comply with the new

817application procedures, which required that verification of her

825educational credentials be made by the director of an APA

835accredited psychology program. The letter stated:

841What you must submit at this point to

849complete your file is your doctoral level

856transcripts, verification of your supervised

861experience as outlined in the application

867materials, and verification of whether or not

874your educational credentials were comparable

879to an APA approved program at the time of

888your graduation. I referred you to either

895Dr. Evelyn Diaz of the Miami Institute of

903Psychology or Dr. Frank DiPiano of Nova

910University for the review of your educational

917credentials as is now allowed by rule of the

926board. You are not restricted to either of

934the above for this review; you may have your

943educational credentials reviewed by the

948director of any doctoral psychology program

954accredited by the APA. Further information

960about this is included in application

966materials that are forthcoming. There is

972also the Domestic Violence form that must be

980submitted; instructions regarding that are on

986the form.

98813. Czukerberg retained Josef Silny & Associates, Inc.

996(Silny), to do an evaluation of her educational credentials. By

1006letter dated September 6, 1996, Silny opined that "Ms. Czukerberg

1016has the equivalent of four years of undergraduate study in

1026Psychology at a regionally accredited U.S. institution of higher

1035education."

103614. In a letter to the Agency dated September 9, 1996,

1047Dr. Donald K. Routh, Director of Clinical Training for the

1057Department of Psychology at the University of Miami, gave the

1067following opinion on Czukerberg's educational credentials:

1073In my opinion, Ms. Czukerberg has

1079completed a course of training in clinical

1086psychology equivalent to that offered by the

1093University of Miami's APA-approved Ph.D.

1098program in clinical psychology. The

1103equivalence of her training to ours in terms

1111of coursework, master's thesis, practicum and

1117internship was obvious. The only question in

1124my mind was whether she could be regarded as

1133having completed the equivalent of a doctoral

1140dissertation. I do believe that the book,

1147Polvo de Anos , (the English translation of

1154the title would be: "Dust of Years")

1162published in 1991 by Editorial Diani, in

1169Mexico City, is comparable in scope and

1176contribution.

117715. In forming his opinion, Dr. Routh had not evaluated the

1188level of difficulty of the courses taken by Petitioner, had not

1199reviewed a syllabus from the University of Costa Rica, and had

1210not read the book Czukerberg had written years after she had

1221graduated from the University of Costa Rica. At the final

1231hearing, Dr. Routh admitted that his opinion was equivocal.

124016. In 1997, while Czukerberg's incomplete application was

1248still pending, the rules for establishing the equivalency of a

1258degree from a foreign university were again amended. Czukerberg

1267was advised that in addition to the other requirements outlined

1277in the January 23, 1996, letter, the rule required an evaluation

1288of educational credentials by a credential's evaluation service

1296acceptable to the Agency.

130017. On March 21, 1997, the Agency received a letter from

1311Czukerberg, along with several items including a portion of

1320Silny's evaluation. Czukerberg expressed her hope that the

1328Agency would soon review her application.

133418. As of May 2, 1997, Czukerberg's application was still

1344incomplete. The Agency had not received the official transcript

1353from the University of Costa Rica nor had it received

1363verification of her supervision. The incomplete application was

1371forwarded to the Agency's credentials committee, who tabled the

1380matter for consideration by the full Board of Psychology.

138919. On June 6, 1997, the Agency voted to deny Czukerberg's

1400application for licensure by examination.

140520. In a letter to Josef Silny & Associates, Inc., dated

1416July 7, 1998, the Director of the Graduate Program in Clinical

1427Psychology at the University of Costa Rica opined on the degrees

1438that are awarded by the University of Costa Rica in Psychology

1449and stated:

1451In reply to your fax of 07-06-98, I proceed

1460to answer the questions you ask me:

14671) The University of Costa Rica does

1474not offer a Doctor Degree in the field of

1483Psychology. There are Licentiate and Master

1489Degree Programs in different areas of

1495Psychology and Graduate Studies in Clinical

1501Psychology.

1502The University of Costa Rica offers Doctor in

1510Philosophy Degrees in other sciences and two

1517types of Masters Degrees: Academic and

1523Professional. The first one emphasizes

1528research in a specific area. The second

1535emphasizes practical training in skills and

1541abilities on a specific area.

1546At the present time the Graduate degree in

1554Clinical Psychology is equivalent to a

1560Professional Master Degree, which is the

1566highest degree a student can obtain in the

1574field of Psychology. We are not aware if in

1583other countries, due to the number of hours

1591of practice and academic courses required,

1597and the time dedicated to training, as I

1605mentioned in my previous fax, said degree

1612could be the equivalent to a Doctor of

1620Clinical Psychology Degree.

1623Furthermore, I would like to clarify that, in

1631order to be accepted in the Graduate Program

1639in Clinical Psychology, the Psychologist must

1645have a Licentiate Degree in Psychology and be

1653a member of the Association of Psychologists.

1660Bachelor Degrees in Psychology are not

1666accepted.

16672) In reply to Point 2, I insist on the

1677following: Graduate studies in Clinical

1682Psychology are the highest level studies that

1689can be done in Costa Rica. There are no

1698Doctor Degree Programs in any area of

1705Psychology.

170621. After reviewing the correspondence from the University

1714of Costa Rica, Silny re-evaluated Czukerberg's educational

1721credentials and issued another report dated August 10, 1998, in

1731which Silny gave the following opinion:

1737In summary, it is the judgment of Josef Silny

1746& Associates, Inc., International Educational

1751Consultants, that Ms. Czukerberg [sic]

1756education in Mexico and Costa Rica is the

1764equivalent of four years of undergraduate

1770study in Psychology, and completion of the

1777U.S. degree of Master of Science in Clinical

1785Psychology earned at a regionally accredited

1791institution of higher education in the United

1798States.

179922. The Agency accepts educational evaluations performed by

1807Silny.

180823. The degrees which Czukerberg received from the

1816University of Costa Rica are not equivalent to a Pys.D., an Ed.D.

1828in psychology, or a Ph.D. in psychology.

1835CONCLUSIONS OF LAW

183824. The Division of Administrative Hearings has

1845jurisdiction over the parties to and the subject matter of this

1856proceeding. Section 120.57(1), Florida Statutes.

186125. Section 490.005, Florida Statutes, sets forth the

1869criteria which must be met by an applicant for licensure as a

1881psychologist. The applicant has the burden to establish that he

1891has received a doctoral-level psychological education as defined

1899in Section 490.003(3), Florida Statutes, or the equivalent if the

1909applicant attended school in a foreign country other than Canada.

191926. Section 490.003(3)(a), Florida Statutes, defines

"1925doctoral-level education" as follows:

1929(3)(a) Prior to July 1, 1999,

1935'doctoral-level psychological education' and

1939'doctoral degree in psychology' mean a

1945Psy.D., Ed.D. in psychology, or a Ph.D. in

1953psychology from:

19551. An educational institution which, at

1961the time the applicant was enrolled and

1968graduated, had institutional accreditation

1972from an agency recognized and approved by the

1980United States Department of Education or was

1987recognized as a member in good standing of

1995the Association of Universities and Colleges

2001of Canada; and

20042. A psychology program within that

2010educational institution which, at the time

2016the applicant was enrolled and graduated, had

2023programmatic accreditation from an

2027accrediting agency recognized and approved by

2033the United States Department of Education or

2040was comparable to such programs.

204527. Rule 64B19-11.0035(4), Florida Administrative Code,

2051sets forth the proof necessary to establish eligibility for

2060examination and provides:

2063(4) The following proof is satisfactory

2069to the Board for the purpose of showing that

2078the applicant's degree obtained outside of

2084the United States or Canada was equivalent to

2092a Ph.D. in psychology, a Psy.D., or an Ed.D.

2101in psychology and was obtained from a program

2109equivalent to a program accredited by a

2116programmatic accrediting agency recognized

2120and approved by the U.S. Department of

2127Education: an original, signed letter on

2133official letterhead confirming same and sent

2139directly to the Board from the director of a

2148doctoral psychology program accredited by the

2154American Psychological Association. The

2158letter shall enumerate the exact documents

2164that were reviewed in determining

2169comparability or augmentation. The Board

2174shall also require the validation of degree

2181and internship equivalence performed by a

2187credential's evaluation service acceptable to

2192the Board.

219428. Czukerberg has not established that the titles of

2203Clinical Psychology Specialist and Clinical Psychologist are

2210equivalent to a Psy.D., an Ed.D. in psychology, or a Ph.D. in

2222psychology. Dr. Routh's opinion was equivocal and was made

2231without reviewing Czukerberg's book or the syllabus from the

2240University of Costa Rica. The opinion of Silny was that

2250Czukerberg's education is equivalent to a Master's Degree in the

2260United States.

2262RECOMMENDATION

2263Based on the foregoing Findings of Fact and Conclusions of

2273Law, it is RECOMMENDED that a Final Order be entered denying

2284Shirley Czukerberg's application for licensure by examination for

2292a psychologist.

2294DONE AND ENTERED this 23rd day of November, 1998, in
