36Pursuant to notice, the Division of Administrative Hearings,

132STATEMENT OF ISSUE
135The issue for disposition in this proceeding is whether
144Petitioner, Ms. Fearon, is entitled to licensure by endorsement
153as a registered nurse in Florida. This requires a determination
163of whether her education is substantially equivalent to or more
173stringent than required in Florida, pursuant to Section 464.009,
182Florida Statutes, and Rule 64B9-3.008, Florida Administrative
189Code.
190PROCEDURAL MATTERS
192In response to an Order by the Board of Nursing denying her
204application, Ms. Fearon requested an administrative hearing, and
212the case was referred to the Division of Administrative Hearings
222where it proceeded as described above.
228At the hearing Ms. Fearon testified in her own behalf and
239presented three documents in support of her application.
247Petitioner's Exhibits nos. 1 and 3 were marked and received in
258evidence; Petitioner's Exhibit no. 2 was withdrawn at the
267Administrative Law Judge's suggestion as it was a duplicate
276document in Respondent's licensure file.
281Respondent, the Board of Nursing, presented testimony of its
290executive director, Ruth Stiehi, Ph.D. and submitted a single
299exhibit, the licensure file for Ms. Fearon, which was received in
310evidence as Respondent's Exhibit no. 1 (composite exhibit).
318The Transcript was filed on November 29, 1999; the court
328reporter also included Petitioner's Exhibit nos. 1 and 3, which
338were apparently misplaced by the court reporter after the
347hearing. Copies of those exhibits will remain in the record; the
358originals are being returned to Ms. Fearon, as requested.
367On December 2, 1999, counsel for the Board of Nursing filed
378a Proposed Recommended Order; on December 6, 1999, Ms. Fearon's
388letter requesting a result of her hearing was received.
397FINDINGS OF FACT
4001. Petitioner Sylem May Fearon (Ms. Fearon) was born in
410Jamaica, approximately 68 years ago. After being educated in
419Jamaica she emigrated to England to pursue an education for the
430practice of professional nursing.
4342. Ms. Fearon took courses in geriatric nursing in England
444for two years, then proceeded to do a three-year general training
455program (1960-1963). After the general registered nursing
462education, she took courses in midwifery for two years, passed an
473examination, and was qualified as a certified nurse midwife in
483September 1965.
4853. Approximately 32 years ago, Ms. Fearon responded to
494nursing recruiters from the United States; she emigrated to the
504United States and commenced working as a staff nurse in a
515hospital in Washington, D.C.
5194. Since emigrating to the United States, Ms. Fearon has
529become a citizen. She took the examinations for nursing
538licensure in New York and Massachusetts and was successful in
548obtaining licensure in both states, as well as in Washington,
558D.C. She maintains current licensure as a registered nurse in
568Washington, D.C.
5705. Approximately two years ago, Ms. Fearon moved to Florida
580and commenced application for licensure by endorsement as a
589registered nurse in this state.
5946. Florida's and other states' nursing boards do not have
604reciprocity with each other in the sense that if you are licensed
616in one state you may also practice in others. Florida and other
628jurisdictions have licensure by endorsement which allows an
636applicant for licensure to demonstrate that he or she has passed
647an examination in another state and has the educational
656background that is substantially the same or more stringent than
666required by the state in which the applicant is seeking
676licensure. This allows an applicant to become licensed without
685having to take another examination but does not waive other
695requirements for licensure such as education.
7017. After Ms. Fearon applied for licensure by endorsement in
711Florida, nursing board staff determined that she met all of the
722requirements except for some areas of her education. The Board
732of Nursing in Florida has developed guidelines to implement its
742broad rules on what specific education is required. When staff
752determines those guidelines are not met, the individual case is
762brought to the Board which then makes the ultimate decision. In
773Ms. Fearon's case, the Board accepted the deficiencies identified
782by its staff and entered the order which Ms. Fearon has
793challenged in this proceeding.
7978. The staff and Board considered a transcript of
806Ms. Fearon's registered nursing education from the University of
815Sheffield School of Nursing and Midwifery, hereinafter referred
823to as the official transcript. Ms. Fearon also provided copies
833of a "Statement and Recommendation by Director of Nursing" dated
843July 20, 1967, hereinafter referred to as Petitioner's
851transcript, and a copy of correspondence from the Chesterfield
860School of Nursing dated May 2, 1968, which stated Ms. Fearon
871attended lectures in elementary psychology (8 hours), psychiatry
879(5 hours) and head injuries (2 hours), hereinafter referred to as
890the 1968 supplement. The official transcript includes coursework
898that is not listed on Petitioner's transcript, and there are
908discrepancies between the official transcript, Petitioner's
914transcript, and the 1968 supplement; however, these discrepancies
922did not prejudice Ms. Fearon, according to Dr. Stiehl, executive
932director of the Board.
9369. According to the official transcript, Ms. Fearon's
944education at the Royal Hospital of Chesterfield in Derbyshire,
953England, consisted of the following coursework in hours:

112810. A nursing license is issued by the Board of Nursing for
1140a general practitioner, i.e. the licensee can work in any area of
1152nursing. Therefore, to practice safely, the licensee needs a
1161basic theoretical underpinning in all the basic areas of nursing:
1171medical, surgical, obstetric, pediatric, and psychiatric nursing.
1178Hours spent in patient care is not equivalent to didactic study.
1189Study of theory provides the proper theoretical base to make good
1200clinical decisions.
120211. The Board's guidelines establish these minimum
1209standards that must be demonstrated before its staff may approve
1219an applicant (education in hours):

125312. Ms. Fearon's official transcript met the minimum
1261requirements in Medical Nursing (theory and clinical), Surgical
1269Nursing (theory and clinical), Pediatric Nursing (clinical only),
1277and Community Health Nursing.
128113. The official transcript documents only 5 hours of
1290theory in Obstetric Nursing and no clinical hours. The official
1300Transcript demonstrates 300 hours of clinical experience in
"1308Gynecology"; however, gynecology cannot be substituted for
1315obstetrics training. Gynecology and obstetrics training are not
1323interchangeable. In gynecology the training looks at the female
1332patient in totality and at a different set of disease processes
1343than in obstetrics; in obstetrics the training focuses not only
1353on the mother but the growth of the fetus and the health of the
1367child. However, Dr. Stiehl reviewed Petitioner's Exhibit no. 3
1376(the midwife certificate) and determined that this documents the
1385necessary training in obstetrics.
138914. The official transcript documents only 8 hours of
1398theory in Pediatric Nursing and no clinical hours. Ms. Fearon
1408testified that her midwifery training covered pediatrics;
1415however, it does not meet the requirements for theory and
1425clinical training in pediatrics. Midwifery training covers the
1433child from birth to age one; pediatrics covers children from
1443birth to age 18.
144715. The official transcript documents only 5 hours of
1456theory in Psychiatric Nursing. The 1968 supplement demonstrates
14645 hours in Psychiatric Nursing and 8 hours in Elementary
1474Psychology. Psychology cannot be substituted for psychiatric
1481training. Basic psychology training looks at normal behavior;
1489psychiatric nursing training deals with comparing normal with
1497abnormal and with disease processes such as manic depression.
1506The course in head injuries is not identified as training in
1517psychiatry. Petitioner's transcript documents 12 weeks of
1524clinical training in psychiatry, and the Board staff reviewer
1533gave her full credit for the needed hours. (See worksheet
1543Respondent's Composite Exhibit no 1.) Although Ms. Fearon
1551asserted that she had psychiatric training in her midwifery
1560program, it would not provide the necessary minimum education in
1570psychiatric theory.
157216. Ms. Fearon's documentation demonstrates deficiencies in
1579psychiatric theory, pediatrics theory, and clinical training.
1586Even if the information on Petitioner's transcript regarding
1594psychiatric clinical experience is accepted, Petitioner still has
1602not demonstrated sufficient theoretical education.
160717. Ms. Fearon testified that she completed two years of
1617geriatric nursing training. No documentation has been provided
1625of what the content of the course was. Education for a lower
1637level of licensure would not be considered as meeting the
1647requirements for licensure as a registered nurse. Ms. Fearon
1656also testified that she completed courses in order to sit
1666for her U.S. licensing examination. However, the courses were
1675not identified, and no documentation of the courses has been
1685submitted.
168618. Ms. Fearon did not document the requirements for
1695licensure in New York in 1973, when she was first licensed in the
1708United States. Instead she has responded to the staff's inquires
1718with an effort to provide documentation of her education, most of
1729which occurred over 35 years ago in a program which no longer
1741exists.
1742CONCLUSIONS OF LAW
174519. The Division of Aministrative Hearings has jurisdiction
1753of this action pursuant to Sections 120.569, 120.57 and 120.60,
1763Florida Statutes.
176520. Section 464.009, Florida Satutes, provides that in
1773order to be licensed by endorsement in Florida as a nurse, the
1785applicant must demonstrate either that she:
1791(a) Holds a valid license to practice
1798professional or practical nursing in another
1804state of the United States, provided that,
1811when the applicant secured his or her
1818original license, the requirements for
1823licensure were substantially equivalent to or
1829more stringent than those existing in Florida
1836at that time; OR
1840(b) Meets the qualifications for licensure
1846in Section 464.008 and has successfully
1852completed a state, regional, or national
1858examination which is substantially equivalent
1863to or more stringent than the examination
1870given by the department.
187421. Ms. Fearon attempted to demonstrate eligibility for
1882licensure under Section 464.009(1)(b), Florida Statutes. The
1889Board agrees that she successfully completed a state examination
1898substantially equivalent to or more stringent than the
1906examination approved by the Board, but she must also demonstrate
1916graduation from an approved nursing program. (See Section
1924464.008(2), Florida Statutes, and Rule 64B90-3.008, Florida
1931Administrative Code.)
193322. The Board defines an "approved nursing program
1941equivalent" as a "nursing program conducted in a school, college
1951or university outside the State of Florida which has been
1961approved by the Board of Nursing in the jurisdiction in which it
1973is located, if such Board exists, and which demonstrates that it
1984meets the education criteria in Chapter 64B9-2 Rules." Rule
199364B9-3.001(2), Florida Administrative Code.
199723. The evidentiary basis for the Board's guidelines was
2006explained briefly at the hearing by Dr. Steihl, as reflected in
2017the findings of fact above. The evidence presented at hearing in
2028Ms. Fearon's testimony, Dr. Steihl's testimony, the licensure
2036file, and Ms. Fearon's documents, establishes that Ms. Fearon's
2045documentation of her education still has deficiencies in
2053pediatric nursing theory (lacks 12 hours of coursework) and
2062psychiatric nursing (lacks 15 hours of coursework).
206924. Ms. Fearon is understandably frustrated at the process
2078of proving her fitness for licensure in Florida after a long
2089successful career in nursing in the United States and a rich and
2101varied educational background. She simply has been unable to
2110sustain her burden of demonstrating that her education meets the
2120Board's specific guidelines in two areas only.
212725. Ms. Fearon now has the option of continuing to provide
2138documentation regarding her hours of coursework in pediatric
2146nursing and psychiatric nursing or seeking endorsement under
2154Section 464.009(1)(a), Florida Statutes. Board staff is urged to
2163assist Ms. Fearon in determining which option she should pursue.
2173There is precedent for the Board's determination that a
2182registered nurse licensed in New York State has met the
2192requirements of Section 464.009(1)(a), Florida Statutes. In the
2200case Jacinth E. Brown v. Board of Nursing , DOAH Case No. 82-0754,
2212Final Order entered February 22, 1983, the Board determined that
2222in 1969 the requirements for registered nurse licensure in
2231New York were equivalent to or more stringent than Florida's
2241requirements. Ms. Fearon's relevant year is apparently four
2249years later, 1973, and it is possible that the same requirements
2260were in effect in both states, with the same felicitious result.
2271RECOMMENDATION
2272Based on the foregoing, it is hereby
2279RECOMMENDED:
2280That the Board of Nursing enter its Final Order denying
2290Petitioner's application for licensure by endorsement without
2297prejudice to her right to pursue her application as described
2307above.
