109STATEMENT OF THE ISSUE

113Whether the Petitioner should be subject to an

121administrative fine for failing to submit a timely renewal of its

132application within the required time frames to the Agency, and if

143so, in what amount?

147PRELIMINARY STATEMENT

149By letter dated June 24, 1999, the Agency for Health Care

160Administration (AHCA) advised the Petitioner, John Knox Village

168of Central Florida Inc. (John Knox), of AHCA's intention to

178impose a $700 administrative fine for Petitioner's failure to

187timely submit a license renewal application. On July 2, 1999,

197Petitioner submitted a request for a formal administrative

205hearing and this hearing ensued.

210At the hearing, Respondent presented the testimony of Jackie

219Clawson, a Program Specialist, and Facilities Consultant, Home

227Care Unit, Bureau of Health Facility Compliance for AHCA, and

237introduced Respondent's Composite Exhibits 1 through 7 which were

246received into evidence.

249Petitioner presented the testimony of Deanna Ferrell,

256Administrator, John Knox Village of Central Florida, Inc., and

265did not introduce exhibits at the hearing.

272The transcript of the hearing was filed on October 7, 1999.

283AHCA submitted proposed findings which were read and considered.

292The Petitioner submitted a letter which was read and considered.

302FINDINGS OF FACT

3051. At all times pertinent to this case, AHCA was the state

317agency responsible for the licensing and regulation of home

326health agencies. John Knox Village of Central Florida, Inc.,

335operates a certified home health agency in Orange City, Florida.

3452. AHCA's consultant, Ms. Jackie Clawson, was called as a

355witness and testified on behalf of AHCA.

3623. Ms. Jackie Clawson testified that she was familiar with

372the facility at John Knox Village of Central Florida, Inc.

3824. Ms. Jackie Clawson identified Respondent's Composite

389Exhibit 1 as a letter that AHCA sends out advising the Petitioner

401that they needed to renew their license. Ms. Jackie Clawson,

411also testified that AHCA should have received John Knox's renewal

421application on or before May 3, 1999. (The actual renewal date

432fell on a weekend, and, therefore, the next business day was

443Monday, May 3, 1999.)

4475. Ms. Jackie Clawson identified Respondent's Composite

454Exhibit 2 as a copy of the renewal application for licensure that

466was received by AHCA with a stamp-date of May 10, 1999.

4776. Ms. Jackie Clawson identified Respondent's Composite

484Exhibit 3 as a copy of Petitioner's prior license with an

495expiration date of June 30, 1999.

5017. Ms. Jackie Clawson identified Respondent's Composite

508Exhibit 4 as a fine and omission letter that is sent to the

521facility stating the items that are missing from the original

531application packet and the fine regarding the late submission of

541the application.

5438. Ms. Jackie Clawson identified Respondent's Composite

550Exhibit 7 as a copy of a letter from Petitioner requesting a

562formal administrative hearing.

5659. Deanna Terrell, Administrator of John Knox Village

573admitted the license renewal was submitted late.

580CONCLUSIONS OF LAW

58310. The Division of Administrative Hearings has

590jurisdiction over the parties and subject matter in this case.

600Section 120.57(1), Florida Statutes, and Rule 400, Part IV,

609Florida Administrative Code.

61211. The evidence showed the application was seven days

621late.

62212. The record shows the Petitioner admits she was late in

633applying for licensure renewal.

63713. Section 400.47, Florida Statutes (1997), states as

645follows:

646Sixty days before the expiration date, an

653application for renewal must be submitted to

660the Agency for Health Care Administration

666under oath on forms furnished by it, and a

675license must be renewed if the applicant has

683met the requirements established under this

689part and applicable rules. The home health

696agency must submit a satisfactory proof of

703its financial ability to comply with the

710requirements of this part.

71414. Rule 59A-8.0086(4), Florida Administrative Code,

720states:

721Failure to file an application within the

728time frames specified in this rule shall

735result in an administrative fine in the

742amount of $100 per day constituting a

749separate violation. In no event shall such

756fines aggregate more than $5,000.

76215. There is no legal basis for reduction of the fine which

774is mandatory.

776RECOMMENDATION

777Based upon the foregoing Findings of Fact and Conclusions of

787Law set forth herein, it is

793RECOMMENDED:

794That the Agency for Health Care Administration enter a final

804order finding Petitioner John Knox Village of Central Florida,

813Inc., submitted an untimely application and levy a fine in the

824amount of $700 against Petitioner.
