104STATEMENT OF THE ISSUE

108The issue in this case is whether the Petitioner's

117application for licensure by endorsement should be approved or

126denied.

127PRELIMINARY STATEMENT

129Following notification that the Board of Nursing ("Board")

139intended to deny her application for licensure by endorsement,

148the Petitioner requested an evidentiary hearing. In due course

157the matter was referred to the Division of Administrative

166Hearings, where it was assigned to an administrative law judge

176and was scheduled for hearing. Following two continuances (both

185requested by the Petitioner), a final hearing was conducted on

195May 31, 2000. At the final hearing the Petitioner, through

205counsel, 1 offered two exhibits. 2 The Petitioner did not call any

217witnesses. The Respondent presented the testimony of one

225witness (Ms. Mark K. Jacobsen, Director of Nursing Education for

235the Board of Nursing), and offered one exhibit, which was

245received in evidence. 3 At the conclusion of the hearing counsel

256for both parties requested that they be allowed until June 30,

2672000, within which to file their respective proposed recommended

276orders. The request was granted.

281On June 13, 2000, a one-volume Transcript of the final

291hearing was filed with the Division of Administrative Hearings.

300On June 29, 2000, the Respondent filed a Proposed Recommended

310Order containing proposed findings of fact and conclusions of

319law. 4 As of the date of this Recommended Order, the Petitioner

331has not filed a proposed recommended order, or any other post-

342hearing document.

344FINDINGS OF FACT

3471. In June of 1997, the Petitioner filed an application

357for nursing licensure, by means of which she seeks to be

368licensed as a registered nurse by endorsement. In support of

378her application, the Petitioner submitted, or caused to be

387submitted, evidence showing that she was licensed as a

396registered nurse in Quebec, Canada, and that she had such

406licensure status by passing an examination in 1976. The

415examination she passed in 1976 was the examination administered

424in French by the Ordre des Infirmieres et Infirmieres du Quebec

435("OIIQ").

4382. In 1976, the registered nurse licensure examination

446given by, or required by, the Florida Board of Nursing was the

458State Board Test Pool Examination, which was administered by the

468National Council of State Boards of Nursing.

4753. In addition to the licensure examination administered

483by OIIQ, the Canadian Nurses Association Testing Service

491("CNATS") has also offered a registered nurse licensure

501examination in Canada for many years, including 1976. The

510Florida Board of Nursing has determined that the CNATS

519registered nurse licensure examinations administered from 1980

526through 1995 are equivalent to the State Board Test Pool

536Examinations administered by the National Council of State

544Boards of Nursing. There has been no such determination for

554CNATS examinations administered before 1980 or after 1995.

5624. The evidence in this case is insufficient to determine

572whether the registered nursing licensure examinations

578administered in 1976 by either CNATS or OIIQ were substantially

588equivalent to, or more stringent than, the State Board Test Pool

599Examinations administered in 1976 by the National Council of

608State Boards of Nursing. 5

613CONCLUSIONS OF LAW

6165. The Division of Administrative Hearings has

623jurisdiction over the parties to and the subject matter of this

634case. Sections 120.69, 120.57(1), and 120.60, Florida Statutes.

6426. The Respondent is the state agency charged with

651regulating the practice of nursing pursuant to Chapters 455 and

661464, Florida Statutes.

6647. In pertinent part, Section 464.009(1), Florida

671Statutes, requires an applicant for licensure by endorsement to

680demonstrate to the Board that he or she:

688(b) Meets the qualifications for

693licensure in s. 464.008 and has successfully

700completed a state, regional, or national

706examination which is substantially

710equivalent to or more stringent than the

717examination given by the department.

7228. The minimum requirements necessary to show the

730examination equivalence required by Section 464.009(1)(b),

736Florida Statutes, are addressed in Rule 64B9-3.008(3), Florida

744Administrative Code, which provides that to be equivalent to the

754exam required by the Board, an examination must meet all five of

766the following criteria:

769(a) The examination is developed using

775accepted psychometric procedures.

778(b) The content and passing score of the

786examination are substantially equivalent to

791that of the National Council Licensure

797Examination.

798(c) The security of the examination is

805maintained.

806(d) At least one of the reliability

813estimations for the examination is 0.7 or

820higher.

821(e) The examination is revised after each

828administration to insure currency of

833content.

8349. The evidence in this case is insufficient to establish

844that the OIIQ examination administered in 1976 met any of the

855five criteria required by Rule 64B9-3.008(3)(a) through (e),

863Florida Administrative Code. 6

86710. In a case of this nature, the Petitioner bears the

878burden of establishing her entitlement to the license she seeks.

888Where, as here, the Petitioner fails to present sufficient

897evidence to demonstrate such entitlement, the license must be

906denied.

907RECOMMENDATION

908On the basis of the foregoing Findings of Fact and

918Conclusions of Law, it is RECOMMENDED that the Board of Nursing

929enter a final order denying the Petitioner's application for

938licensure by endorsement.

1189CNATS examination. There is no evidence that either the 1976

1199OIIQ examination or the 1976 CNATS examination was "substantially

1208equivalent to or more stringent than" the 1976 State Board Test

1219Pool Examination administered by the National Council of State

1228Boards of Nursing.

12316/ The only documentary evidence that specifically addresses the

1240criteria in Rule 64B9-3.008(3)(a) through (e), Florida

1247Administrative Code, is Respondent's Exhibit 1. The information

1255in that document fails to establish that the 1976 OIIQ

1276testimony of Ms. Jacobsen emphasizes the deficiencies in the

1285documentary evidence.
