53ER13. Emergency Rule For Year 2013 |
1(1) 2The Florida Lottery will 6conduct, as a retailer sales incentive, a Retailer 14Instant Ticket 16Bonus C18ommission Program (“Program”).
21(22223) Florida Lottery retailers who sell a winning 31in32stant 33ticket 34with a prize of $1,000,000 or 42greater 43will receive a bonus commission of $2,000 for ev53ery $1,000,000 in prize value. 60For example, a retailer who sells a 67winning 68instant ticket with a $3,000,000 prize 76will receive a bonus commission of $836,8400085.
86(87388) Award of a bonus commission is dependent upon 97the 98winning 99instant 100ticket being 102claimed 103by the winner.
106(4107) Retailers whose Florida Lottery contracts are terminated or inactivated prior to the bonus commission award shall be paid the bonus commission earned provided said termination or inactivation was not due to noncompliance with Chapter 24, 143F.S., 144Chapter 53, 146F.A.C., or contract terms.
150(1515152) A bonus commission will be considered compensation to the retailer for Internal Revenue Service purposes. The Florida Lottery reserves the right to apply a bonus commission earned against a retailer’s outstanding debt to the Florida Lottery, and to award the remaining balance of the bonus commission, if any.
201(2026203) Bonus commissions are subject to availability of funds appropr213iated for retailer incentives. 217This Program is subject to cancellation by future emergency rule if retailer incentive funding is not appropriated or if the Florida Lottery determines that it is no longer in the state’s best interest to use such funds for this purpose.
