53ER17-25. GROUPER® Retailer Sales and Triple Sales Commission  


Effective on Thursday, April 27, 2017
  • 1(1) Beginning May 1, 2017, and continuing through June 25, 2017, (“Promotional Period”) the Florida Lottery will conduct as a retailer sales incentive, the GROUPER26® 27Retailer Sales and Triple Sales Commission program. During the Promotional Period, the Florida Lottery will pay Florida Lottery retailers a $.30 sales commission for each GROUPER53® 54play sold, except as provided in subsection (3), 62below. The $.30 sales commission includes the five percent sales commission set forth in Rule 53ER13-46 F.A.C., 79Retailer Compensation, 81on the purchase price of the $1.00 PICK 290 91ticket, the $2.00 FLORIDA LOTTO96® 97with XTRA 99ticket, the $2.00 FANTASY 5104® 105with EZmatch107 108ticket and a five percent sales commission on the promotional FREE $1.00 LUCKY MONEY122 123ticket 124included in the GROUPER play.

    129(2) As a bonus, during the first thirty-one (31) days of the Promotional Period (May 1, 2017 – May 31, 2017 “Triple Sales Commission Period”), the Florida Lottery will pay Florida Lottery retailers an additional $.60 bonus sales commission for each GROUPER171® 172play sold, except as provided in subsection (3) below, for a $.90 total sales commission (or triple sales commission).

    191(3) If the Quick Pick numbers selected for the PICK 2 game have been cut off for the day due to the game’s liability limit being reached so that the PICK 2 ticket does not print, the purchase price of the transaction will be automatically adjusted, and the retailer will receive the otherwise applicable sales commission (depending on the transaction date) on only the remaining GROUPER tickets, including the promotional FREE $1 LUCKY MONEY265 266ticket.

    267(4) GROUPER $.30 sales commissions will be reflected on the retailer’s weekly Settlemen280t Report.

    282(5) GROUPER $.60 bonus sales commissions will be reflected on the retailer’s weekly Settlement Report at the conclusion of the Triple Sales Commission Period.

    306(6) Retailers whose Florida Lottery contracts are terminated or inactivated prior to payment of the $.60 bonus sales commissions shall be paid the commissions earned provided said termination or inactivation was not due to noncompliance with Chapter 24, F345.346S347., 348Chapter 53, F351.352A353.354C355., 356or terms of the retailer contract.

    362(7) GROUPER $.60 bonus sales commissions will be considered compensation to the retailer for Internal Revenue Service purposes. The Florida Lottery reserves the right to apply a $.60 bonus sales commission earned against a retailer’s outstanding debt to the Florida Lottery.
