61E1-1.001. Asbestos Consultants/Contractors; Licensure Requirements  


Effective on Tuesday, November 11, 1997
  • 1(1) The Department will accept as meeting the requirements for licensure as an asbestos consultant as defined in Section 20469.001(5), F.S., 22any individual who meets the requirements set forth in Sections 32469.004(1) 33and 34469.005, F.S.

    36(2) The Department will accept as meeting the requirements for licensure as an asbestos contractor as defined in Section 55469.001(7), F.S., 57any individual who meets the requirements set forth in Sections 67469.004(2) 68and 69469.005, F.S.

    71(3)(a) The Department shall accept as evidence of financial stability, as required in Section 85469.005(5), F.S., 87a statement from the applicant that he/she has not had any asbestos projects which were not satisfactorily completed and that no claims exist on asbestos projects that have been completed; and compliance with paragraph 12161E1-4.001(1)(c), 122F.A.C.

    123(b) The Department shall accept as meeting the requirements of Section 134469.005(6), F.S., 136an applicant who has paid the appropriate examination fee and passed the Department administered examination set forth in Rules 15561E1-2.001 156through 15761E1-2.005, 158F.A.C.

    159(4) To satisfy the requirements of Section 166469.005(4), F.S., 168the applicant must submit evidence of ten asbestos projects within the last five years, with said evidence containing a description of the project, the level of responsibility, the dates of the engagement and a statement that no claims of unsatisfactory professional services have been sustained against the professional activities of the applicant. This statement must be certified by the owner or entity for whom the service was rendered.

    236(a) Distribution of the ten projects for an asbestos consultant shall be as follows:

    2501. Two projects involving asbestos surveys;

    2562. Two projects involving the development of operations and maintenance plans;

    2673. Two projects involving asbestos abatement project management and supervision;

    2774. Two projects involving the design of asbestos abatement projects; and,

    2885. Two additional projects from any of the above categories.

    298(b) The ten projects for an asbestos contractor shall involve asbestos abatement activities.
