61B-23. The Association |
1(1) “Cable television service,” as used in Section 10718.115(1)(d)2., 11Florida Statutes, shall mean the transmission of video programming by a duly franchised cable company, as provided in Section 166.046, Florida Statutes, or as that section may be subsequently renumbered, pursuant to a contract between the association and such duly franchised cable company. For the purposes of this rule, cable television service shall include any master antenna or community antenna television system.
73(2) “Legally blind,” as used in Section 81718.115(1)(b), 82Florida Statutes, shall mean having central visual acuity of 20/200 or less in the better eye with corrective glasses or a disqualifying field defect in which the peripheral field has contracted to such an extent that the widest diameter of visual field subtends an angular distance no greater than 20 degrees.
133(3) “Hearing impaired,” as used in Section 141718.115(1)(d)2., 142Florida Statutes, shall mean:
146(a) An individual who has suffered a permanent hearing impairment and is not able to discriminate speech sounds in verbal communication, with or without the assistance of amplification devices; or
176(b) An individual who has suffered a permanent hearing impairment which is severe enough to necessitate the use of amplification devices to discriminate speech sounds in verbal communication.
204(4) A legally blind or hearing impaired unit owner seeking to discontinue cable television service in accordance with Section 223718.115(1)(d)2., 224Florida Statutes, shall furnish proof to the board of directors of the association that the individual is legally blind or hearing impaired. The association shall accept as proof of the impairment a statement attesting to such impairment from one of the following:
266(a) A licensed physician, audiologist, or speech pathologist;
274(b) A state certified teacher of the visually impaired or of the hearing impaired; or
289(c) An appropriate state or federal agency.
