1(1) This general permit authorizes return water from an upland contained dredged material disposal area, when:
17(a) The return water will not adversely affect the quality of receiving waters such that the state water quality standards set forth in Chapters 62-4, 62-302, 62-520, and 62-550, F.A.C., including the antidegradation provisions of paragraphs 5362-4.242(1)(a) 54and (b), subsections 5762-4.242(2) 58and (3), and Rule 6262-302.300, 63F.A.C., and any special standards for Outstanding Florida Waters and Outstanding National Resource Waters set forth in subsections 8162-4.242(2) 82and (3), F.A.C., will be violated;
88(b) The return water is not part of an activity that requires an individual permit (if so, return water will be addressed within the individual permit).
