62-331. State 404 Program |
1(1) This general permit authorizes dredging or filling associated with hydropower projects having:
14(a) Less than 5000 kW of total generating capacity at existing reservoirs, where the project, including the fill, is licensed by the Federal Energy Regulatory Commission (FERC) under the Federal Power Act of 1920; or
49(b) A licensing exemption granted by the FERC pursuant to section 408 of the Energy Security Act of 1980 (6916 U.S.C. §§2705 72and 2708) and section 30 of the Federal Power Act.
82(2) The permittee must submit a notice of intent to use this general permit to the Agency prior to commencing the activity.
