62-341.201. Policy and Purpose (Transferred)

  • 1(1) The purpose of Part II of this chapter is to provide noticed general environmental resource permits for those activities which have been determined to have minimal impacts to the water resources of the District, both individually and cumulatively, when conducted in compliance with the terms and conditions of the general permit. Unless specifically provided for in the general permit, mitigation is neither necessary nor required for activities that qualify for noticed general permits. Persons wishing to use one or more of the general permits under this 88P89art shall be subject to the notice provisions of Rule 9962-343.090, 100F.A.C., 101or, for activities within the geographical area of the Northwest Florida Water Management District, Rule 11662-346.090, 117F.A.C., 118before any activity is conducted as authorized herein. The general conditions provided pursuant to Rule 13362-341.215, 134F.A.C., shall apply to all of the noticed general permits in this 146P147art. Strict compliance with all of the terms, conditions, requirements, limitations and restrictions applicable to a desired noticed general permit under this 169P170art is required to qualify for such a permit.

    179(2) A review of the number, kind, ecological effects and compliance of general permits on water resources of the state individually and cumulatively shall be undertaken by the Department after consultation with the water management districts every three years with a report to the Secretary and the Environmental Regulation Commission.
