62-532.430. Intent to Deny a Water Well Construction Permit  


Effective on Sunday, July 30, 1989
  • 1(1) The permitting authority shall issue an intent to deny whenever it determines that an application for a permit under Rule 2262-532.400, 23F.A.C., fails to meet the requirements of Chapter 373, F.S., or any rule, order, or standard adopted pursuant thereto, or that the proposed well will be harmful to the water resources of the State.

    57(2) The intent to deny shall:

    63(a) State the grounds for denial, and

    70(b) Be served in writing upon the owner and user by registered or certified mail.

    85(3) Any person receiving an intent to deny may petition for hearing by filing a written petition with the permitting authority within 30 days of the receipt of the intent. The hearing shall be conducted pursuant to Chapter 120, F.S.
