62-780.560. Petroleum or Petroleum Product De Minimis Discharges

  • 1(1) 2For purposes of this rule section, a “petroleum 10or petroleum product 13de minimis discharge” means a 18discharge of petroleum or petroleum products of less than 25 gallons onto a pervious surface 33or that moves onto a pervious surface from an impervious surface44. Such discharge is exempt from the notification requirements of subsection 5562-780.220(1), 56rules 5762-780.500 58and 62-780.525, F.A.C., as long as the discharge is removed and properly treated or properly disposed, or otherwise remediated, pursuant to the applicable provisions of rule 8462-780.500 85or 62-780.525, F.A.C., so that 90CTLs or background concentrations pursuant to subsection 9762-780.680(1), 98F.A.C., are achieved.

    101(2) For purposes of this rule section, 108a “petroleum 110or petroleum product 113de minimis discharge” 116also means a discharge of petroleum or petroleum products of 25 to 500 gallons onto a pervious surface 134or that moves onto a pervious surface from an impervious surface, 145that is not associated with a regulated petroleum storage system and has not impacted groundwater, and for which the FDEP Office of Emergency Response oversees the response actions, if at the conclusion of the emergency response action, 182CTLs or background concentrations pursuant to subsection 18962-780.680(1), 190F.A.C., are achieved193. These de minimis discharges shall be addressed as an 203emergency response removal or an 208interim source removal and shall be subject to the applicable requirements of rule 22162-780.500 222or 62-780.525, 224F.A.C., 225respectively, 226including notification and reporting. If the information presented in the 236Emergency Source Removal Report or 241Interim Source Removal Report confirms that no contamination remains at the conclusion of the emergency response action, 258the Department will indicate in writing that information provided on a Discharge Reporting Form, 272incorporated in rule 27562-761.900, 276F.A.C. [Form Number 27962-761.900(1)280], 281or other discharge record will no longer be tracked by the Division of Waste Management and that no other site rehabilitation requirements of this chapter are required to be followed311.
