65E-5.320. Discharge of Persons on Involuntary Status

1A receiving or treatment facility administrator shall provide prompt written notice of the discharge of a person on involuntary status to the person, guardian, guardian advocate, representative, initiating professional, and circuit court, with a copy retained in the person’s clinical record. Recommended form CF-MH 3038, “Notice of Release or Discharge,” as referenced in paragraph 5665E-5.280(7)(e), 57F.A.C., may be used as documentation of such notice. If the discharge occurs while a court hearing for involuntary placement or continued involuntary placement is pending, all parties including the state attorney and attorney representing the person, shall be given telephonic notice of the discharge by the facility administrator or his or her designee.
