69B-231.090. Penalties for Violations of Section 626.621, F.S.

  • 1The following stated penalties shall apply for violations under section 11626.621, F.S., 13regarding discretionary suspension or revocation of license(s) and appointments(s):

    22(1) Section 24626.621(1), F.S. 26– revocation.

    28(2) Section 30626.621(2), F.S. 32– suspension for 3 months.

    37(3) Section 39626.621(3), F.S. 41– suspension for 3 months.

    46(4) Section 48626.621(4), F.S. 50– suspension for 9 months.

    55(5) Section 57626.621(5), F.S. 59– suspension for 6 months.

    64(6) Section 66626.621(6), F.S. 68– see rule 7169B-231.100, 72F.A.C.

    73(7) Section 75626.621(7), F.S. 77– suspension for 6 months.

    82(8) Section 84626.621(8), F.S. 86– suspension for 3 months.

    91(9) Section 93626.621(9), F.S. 95– suspension for 6 months and re-exam.

    102(10) Section 104626.621(10), F.S. 106– suspension for 3 months.

    111(11) Section 113626.621(11), F.S. 115– suspension for 6 months.

    120(12) Section 122626.621(12), F.S. 124

    125(a) The maximum identical or substantially similar penalty to the penalty imposed by the court, state or federal agency, or national securities, commodities or options exchange or association for the same type of violation.

    1591. A penalty of revocation, removal, lifetime bar, lifetime ban, lifetime prohibition, or its equivalent, or any suspension with a duration greater than 24 months, shall result in revocation; and,

    1892. A penalty of suspension with a duration of less than 24 months shall result in a suspension of equal duration.

    210(b) When substantially similar penalties are not available, the following penalties shall apply:

    2231. Penalties applicable to warnings, fines, restitution, cease and desist orders, injunctions, censures, probations, license denials, and licensing restrictions:

    242a. Suspension for 6 months when the order does not contain allegations or findings related to monetary loss, fraud, misappropriation, conversion, or unlawful withholding of money.

    268b. Suspension for 12 months when the order contains allegations or findings related to monetary loss, fraud, misappropriation, conversion, or unlawful withholding of money.

    2922. Penalties applicable to all other situations:

    299a. Suspension for 3 months when the order does not contain allegations or findings related to monetary loss, fraud, misappropriation, conversion, or unlawful withholding of money.

    325b. Suspension for 9 months when the order contains allegations or findings related to monetary loss, fraud, misappropriation, conversion, or unlawful withholding of money.

    349(13) Section 351626.621(13), F.S. 353– suspension for 6 months.

    358(14) Section 360626.621(14), F.S. 362– suspension for 6 months.

    367(15) 368Section 369626.621(15), F.S 371

    372(a) The maximum identical or substantially equivalent penalty to the penalty imposed by this state, any other state, any nation, any possession or district of the United States, any court, or any state or federal agency, for the same type of violation.

    4141. A penalty of revocation, removal, lifetime bar, lifetime ban, lifetime prohibition, or its equivalent, or any suspension with a duration greater than 24 months, shall result in revocation; and,

    4442. A penalty of suspension with a duration of less than 24 months shall result in a suspension of equal duration.

    465(b) When substantially similar penalties are not available, the following penalties shall apply:

    4781. Penalties applicable to warnings, fines, restitution, cease and desist orders, injunctions, censures, probations, license denials, and licensing restrictions:

    497a. Suspension for 6 months when the order does not contain allegations or findings related to monetary loss, fraud, misappropriation, conversion, or unlawful withholding of money.

    523b. Suspension for 12 months when the order contains allegations or findings related to monetary loss, fraud, misappropriation, conversion, or unlawful withholding of money.

    5472. Penalties applicable to all other situations:

    554a. Suspension for 3 months when the order does not contain allegations or findings related to monetary loss, fraud, misappropriation, conversion, or unlawful withholding of money.

    580b. Suspension for 9 months when the order contains allegations or findings related to monetary loss, fraud, misappropriation, conversion, or unlawful withholding of money.
