6A-6.03031. Exceptional Student Education Eligibility for Infants and Toddlers Birth Through Two Years Old who are Developmentally Delayed
1(1) Definition. 3An infant or toddler 7who is developmentally delayed is defined as a child from birth through two years of age who has a delay in one (1) or more of the following 35developmental domains37:
38(a) Adaptive development;
41(b) Cognitive development;
44(c) Communication development;
47(d) Social or emotional development;
52(e) Physical development;
55(2) Criteria for eligibility. 59An infant or toddler with a developmental delay 67is eligible for 70exceptional student education when a team of qualified professionals and the parent or guardian in accordance with subsection 886A-6.0331(6), 89F.A.C., determine that all the following criteria are met98:
99(a) The child is below the age of 107thirty-six (36) 109months;
110(b) There is documentation of one of the following:
1191. A score of 1.5 standard deviations below the mean in 130two (2) or more developmental domains as measured by at least one (1) appropriate diagnostic instrument and procedures, and informed clinical opinion; 152or
1532. 154A score of 2.0 standard deviations below the mean in one (1) developmental domain as measured by at least one (1) appropriate diagnostic instrument and procedures, and informed clinical opinion; or
1853. Based on informed clinical opinion 191a determination has been made that a developmental delay exists.
201(c) The requirements of subsection 2066A-6.0331(2), 207F.A.C., have been met; and
212(d) There is written evidence that the Department of Health, Children’s Medical Services, Part C Local Early Steps has determined that the infant or toddler has a developmental delay as defined in paragraph (2)(b) of this rule; and
250(e) The infant or toddler needs early intervention services as defined in paragraph 2636A-6.03411(1)(i), 264F.A.C.
265(3) Continued eligibility. Continued eligibility for exceptional student education shall be determined before the child’s third birthday 282in accordance with Rule 2866A-6.03026, 287F.A.C288.
