9J-22.005. Approval of Amendments to the City of Key West Land Development Regulations (Transferred)

(1) Ordinances 87-37, 87-39, 88-3, 88-10, and 88-15. The Department of Community Affairs has determined that the following land use ordinances adopted by the City of Key West, are in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Rule 28-36, F.A.C. The following ordinances and resolution which amend the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, hereinafter referred to as the “Code”.

(a) Ordinance 87-37, revising the Planned Redevelopment District Standards by amending Section 35.07 of the Code.

(b) Ordinance 87-39, amending Section 31.007 of the Code.

(c) Ordinance 88-3, amending Section 31.010 and repealing Section 33.06 of the Code.

(d) Ordinance 88-10, amending Section 35.19(a) of the Code.

(e) Ordinance 88-15, amending Section VII of the zoning code in Chapter 35 of the Code.

(f) The following ordinance which amends the boundaries of the City of Key West set forth in the City Charter: Ordinance 87-36 (87-T-1), annexation to the City of Key West certain real property known as Tank Island.

(2) The Department of Community Affairs has determined that Ordinance 88-30, adopted by the City of Key West and amending Section 35.07(14) of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, is in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-36, F.A.C.

(3) The Department of Community Affairs has determined that Ordinance 89-6 amending Section 35.07 and Ordinance 89-14, amending Sections 34.13, 73.17, 74.44, and 35.07 of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, are in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Rule 28-36.003, F.A.C.

(4) The Department of Community Affairs has determined that Ordinance 89-22 amending Section 31.003 of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, is in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-36, F.A.C.

(5) The Department of Community Affairs has determined that Ordinance 89-27, amending Section 35.07 and Ordinance 89-28, amending Section 34.05 of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, are in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Rule 28-36.003, F.A.C.

(6) The Department of Community Affairs has determined that Ordinance 90-6 amending Section 34.06 of the Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, is in compliance as adopted by the City of Key West with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Rule 28-36.003, F.A.C.

(7) The Department of Community Affairs has determined that Ordinance 90-8 amending Chapter 16 of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, is in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Rule 28-36.003, F.A.C.

(8) The Department of Community Affairs has determined that Ordinance 90-24 amending Section 35.07(14) of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, is in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-36, F.A.C.

(9) The Department of Community Affairs has determined that Ordinance 90-25 correcting a scrivener’s error in the legal description of Tank Island set forth in Section 1 of Ordinance 87-36 as enacted on September 30, 1987, approved by subsection 9J-22.005(2), F.A.C., is in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Rule 28-36.003, F.A.C.

(10) The Department of Community Affairs has determined that Ordinance 91-16 amending Section 35.07(14) of the Key West City Code is in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Rule 28-36.003, F.A.C.

(11) The Department of Community Affairs has determined that Ordinance 91-40, amending Section 35.09(12) of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, is in compliance as adopted by the City of Key West with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-36, F.A.C.

(12) The Department of Community Affairs has determined that Ordinances 92-2, 92-3, and 92-4 amending Sections 34.13(1), 73.17(H) and 74.44(I) respectively, of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, are in compliance as adopted by the City of Key West with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C.

(13) The Department of Community Affairs has determined that Ordinance 92-10 amending Section 35.09(12) of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, is in compliance as adopted by the City of Key West with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C.

(14) The Department of Community Affairs has determined that the land development regulations in Ordinance 92-42 amending Sections 34.06, 34.12, and 34.16 of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, are in compliance as adopted by the City of Key West with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C.

(15) The Department of Community Affairs has determined that Ordinance 92-63 amending the district classification under the zoning ordinance (Ordinance No. 78-43) of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, is in compliance with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C.

(16) The Department of Community Affairs has determined that the regulations in Ordinance 93-20 amending section 35.07(14) of the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, are in compliance as adopted by the City of Key West with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C., and are hereby approved.

(17) The Department of Community Affairs has determined that Ordinances 93-36, 93-37, 93-38, and 93-39 amending the Comprehensive Plan and the 1986 Code of Ordinances of the City of Key West, Florida, as supplemented through January 5, 1987, are in compliance as adopted by the City of Key West with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C., and are hereby approved.

(18) The Department of Community Affairs approves the City of Key West’s land development regulation adopted by Ordinance 94-22. Ordinance 94-22 amends Section 35.07(14) “Planned Redevelopment District” (PRD) of the Key West City Code. The Department of Community Affairs has determined that this land development regulation is consistent with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C.

(19) The Department of Community Affairs approves the City of Key West’s land development regulations adopted by Ordinances 93-56 and 94-27. Ordinance 93-56 amends Section 35.09 of the Key West City Code. Ordinance 94-27 amends Sections 31.142, 31.208, and 31.012 of the Key West City Code. The Department of Community Affairs has determined that these land development regulations are consistent with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C.

(20) The Department of Community Affairs approves the City of Key West’s land development regulation adopted by Ordinance 94-6. Ordinance 94-6 amends Sections 31.003, 31.092, 31.118, 31.167, and 31.181, and creates Sections 31.2011 and 31.217 of the Key West City Code. The Department of Community Affairs has determined that this land development regulation is consistent with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C.

(21) The Department of Community Affairs approves the City of Key West’s land development regulation adopted by Ordinance 94-42. Ordinance 94-42 amends Section 34.1377(1)(A) of the Key West City Code to provide that applications for vested rights determinations may be submitted no later than 9 months after the effective date of Ordinance No. 93-37, and repeals inconsistent sections. The Department of Community Affairs has determined that this land development regulation is consistent with the Principles for Guiding Development for the City of Key West Area of Critical State Concern, Chapter 28-26, F.A.C.
