64B13-5.002Criteria for Approval

The Board of Optometry hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed May 20, 2014, by Richard J. Madonna, MA, OD, FAAO, on behalf of the State University of New York, College of Optometry, Office of Continuing Education. Notice of Petition for Waiver or Variance was published May 30, 2014, in Vol. 40, No. 105, of the Florida Administrative Register. Petitioner sought a waiver or variance of paragraph 64B13-5.002(3)(c), F.A.C., to allow a one-time waiver of the requirement that a Continuing Education course be approved as Transcript Quality prior to the course being offered. The Board considered the Petition at a duly-noticed public meeting held July 23, 2014, in Boca Raton, Florida. The Board’s Order, filed August 13, 2014, denied the Petition because Petitioner has not demonstrated that the purpose of the underlying statute has been achieved by other means and Petitioner has not demonstrated application of the rule would violate principles of fairness.
