NOTICE IS HEREBY GIVEN that Board of Psychology has issued an order disposing of the petition for declaratory statement filed by Louis F. Damis, PhD, ABPP. on June 20, 2018. The following is a summary of the agency's disposition of the petition: The Notice of the Petition was published in Volume 44, No. 160, of the August 16, 2018, issue of the Florida Administrative Register. The Board reviewed the Petition at its meeting held on August 24, 2018. The Petitioner is requesting a declaratory statement concerning subsection 490.003(4), F.S., which allows for licensed psychologist to employ biofeedback within the scope of practice as a psychologist. However, the psychology statute cannot be used to restrict other professionals from activities for which they are trained and duly qualified to perform. The Board of Psychology only has the authority to govern the practice of psychologists. As stated in Rule 28-105.001, F.A.C., a declaratory statement is not the appropriate means for determining the conduct of another person. It cannot define the practices of clinicians, technicians or those otherwise licensed to practice in other fields. Wherefore, the petition for declaratory statement is responded to in part and denied in part.
