NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has declined to rule on the petition for declaratory statement filed by Shores of Panama Resort Community Association, Inc. on January 16, 2019. The following is a summary of the agency's declination of the petition: The Division is unable to issue a declaratory statement on an issue not within the statutory authority of the Division; the Division is unable to issue a declaratory statement that seeks guidance for the determination of conduct of another person; the Division is unable to issue a declaratory statement when there are unit owners who will be affected by the decision and who are not parties to the petition; and the Division is unable to interpret the meaning and intent of an association’s governing documents.
