    NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Neal Lampel. The petition seeks the agency's opinion as to the applicability of 61B-45.048 as it applies to the petitioner.

    1. Whether Petitioner should expect a similar ruling by an arbitrator pursuant to the previous arbitrator’s findings based on Rule 61B-45.048, Florida Administrative Code, should the association choose to file another petition for arbitration. 2. Whether the relief sought can be retroactively applied to an event that is inextricably tied to a single event, scheduled to conclude after the filing of a petition for arbitration. 3. Whether Petitioner will be held in violation of the arbitrator’s final order should he decide to run for the board of directors and distribute campaign material door-to-door again.
