    The Division of Licensing hereby gives notice: on January 19, 2016, the Department issued an Order Granting In-Part and Denying In-Part, a Petition for Variance filed by The Safety & Intelligence Institute, Inc. (S2), on October 20, 2015. Notice of the Petition was published on October 23, 2015, in Volume 41, No. 207, of the Florida Administrative Register.

    Petitioner sought a variance from paragraph 5N-1.140(1)(c), F.A.C, asking that the scores of all examinations be aggregated with 76% of correctly answered questions needed to achieve a passing score. The Division’s order granted S2’s request to aggregate examination scores, but instead of requiring a 76% passage rate, the Division authorized S2 to require each student correctly answer 128 questions out of the 170 questions asked to achieve a passing score.
