Notice is hereby given that the Board of Medicine has received a Petition for Declaratory Statement filed on behalf of Florida Arthritis & Rheumatology Associates, LLC (FARA), on January 23, 2018. The Petitioner seeks a declaratory statement from the Board with regard to whether FARA’s pharmacy’s fulfilment of prescriptions provided to FARA patients by FARA physicians constitutes prohibited conduct falling under the Florida Self-Referral Law’s (Section 456.053, F.S.) and whether FARA would lose its Group Practice Exception by virtue of its pharmacy accepting and filling prescriptions issued by non-FARA physicians to non-FARA patients. The Board will consider this petition at its meeting currently scheduled for Friday, April 6, 2018. Except for good cause shown, motions for leave to intervene must be filed within 21 days after publication of this notice.
