NOTICE IS HEREBY GIVEN that Board of Architecture and Interior Design has issued an order disposing of the petition for declaratory statement filed by Interiors by Steven G., Inc., on July 01, 2019. The following is a summary of the agency's disposition of the petition:

The Notice of Petition for Declaratory Statement was published in Vol. 45, No. 123, of the July 2, 2019, Florida Administrative Register. The petition sought the Board’s interpretation of 481.213, F.S., and asks whether the Petitioner is authorized pursuant to disclosures in its interior design contract and power of attorney forms to select and hire licensed State of Florida general contractors/specialty subcontractors for interior design construction related activities and State of Florida license architects on behalf of clients and to perform contract administration and management responsibilities with respect to performance, payment and invoicing for those licensed professionals? The Board considered the petition at its meeting held on July 23, 2019, in Orlando, Florida. The Board’s Order, filed on November 18, 2019, declines to answer the question in relation to Architects because the Board found subsections 481.203(6) and (8), F.S., clearly answer the question; declines to answer the remainder of the question as it relates to Florida licensed Building Contractors and specialty sub-contractors governed by Chapter 489, Part I, F.S.; and declines to answer the Petition because it is overly broad and inappropriate for obtaining a policy statement of general applicability.
