14-46.001: Utilities Installation or Adjustment

The Department of Transportation hereby gives notice: that on December 20, 2012, the Department of Transportation entered an Order Granting Waiver from Section 4.5.2 of the Utilities Accommodation Manual, incorporated by reference in Rule 14-46.001, F.A.C. On September 24, 2012, Jacksonville Electric Authority (JEA) requested a waiver from tree mitigation requirements for JEA’s tree removal related to its installation of a proposed electric transmission line. Notice of the Petition for Waiver was published in the October 1, 2012 edition of the Florida Administrative Register. The Petitioner has demonstrated the purpose of the statutes underlying Rule 14-46.001, F.A.C., can be achieved through other means, and would create a substantial hardship and result in an unfair and unintended result. Petitioner’s request for waiver is granted.
