64B9-3.002Qualifications for Examination
The Board of Nursing hereby gives notice: of the issuance of an Order regarding the Petition for Waiver or Variance, which was filed on June 12, 2023, by Nise Blair. The Notice of Petition for Waiver or Variance was published in Volume 49, Number 119, of the June 20, 2023, Florida Administrative Register. Petitioner requested a variance or waiver from subsection 64B9-3.002(2), F.A.C., which states in part that the qualifications for examination for graduates of an approved nursing program, a notice of graduation or of completion of the requirements for graduation.
The Board considered the instant Petition at a duly-noticed public meeting held August 2-4, 2023, in Tampa, Florida. The Board’s Order, filed on September 14, 2023, denied the petition finding that Petitioner failed to establish that the purpose of the underlying statute would be met by granting a variance or waiver from subsection 64B9-3.002(2), F.A.C. The Board further finds that Petitioner failed to establish that applying the requirements of the aforementioned rule to petitioner’s circumstances would violate principles of fairness and impose substantial hardship.
