    Board of Professional Engineers

    The Board of Professional Engineers hereby gives notice of the issuance of an Order regarding the Petition for Variance or Waiver, filed on June 14, 2017, by Kunjan Shukla. The Notice of Petition for Variance or Waiver was published June 21, 2017 in Vol. 43, No. 120 of the Florida Administrative Register. Petitioner sought a variance from or a waiver of paragraphs 61G15-20.007(1)(a) and (b), F.A.C.’s requirement that applicants for licensure without EAC/ABET accredited degrees possess required hours of coursework in specified areas. The Board considered the Petition at a duly-noticed public meeting held on August 10, 2017, in Orlando, Florida. The Board’s Order, filed on September 7, 2017, finds the petition was in substantial compliance with the provisions of Section 120.542, Florida Statutes, and Chapter 28-104, Florida Administrative Code. Petitioner will be allowed to satisfy all educational deficiencies through CLEP courses, and is granted additional time to complete the courses. The Board finds that granting this request would allow Petitioner to achieve the purpose of the underlying statute by other means, and requiring strict compliance with the rule’s requirements would constitute an undue hardship on Petitioner, and GRANTED the Petition IN PART.
