The Board of Massage Therapy hereby gives notice: of the issuance of an Order regarding the Petition for Variance or Waiver, filed on June 17, 2019, by Virginia Graves. The Notice of Petition for Waiver or Variance was published in Vol. 45, No. 123, of the June 25, 2019, Florida Administrative Register. Petitioner sought a variance or waiver of paragraph 480.041(5)(c), F.S., regarding licensing procedures for practitioners desiring to be licensed in this state. The Board considered the instant Petition at a duly-noticed public meeting held on August 1 and 2, 2019, in Tallahassee, Florida. The Board’s Order, filed on October 4, 2019, denied the petition stating that Petitioner failed to meet the requirements to be considered for variance or waiver of a rule and that statutes cannot be waived.
