  • NOTICE IS HEREBY GIVEN THAT the Department of Financial Services, Division of State Fire Marshal has declined to rule on the petition for declaratory statement filed by Marshal A. Seymour on September 18, 2009. The following is a summary of the agency's declination of the petition:
    The Declaratory Statement was requested pursuant to the provisions of Section 120.565, F.S., and Rule 28-105, F.A.C., which authorizes a substantially affected person to seek a declaratory statement regarding an agency’s opinion as to the applicability of a statutory or rule provision as it applies to the Petitioner’s particular set of circumstances. The Petition does not set forth any specific facts to which the Department can apply the statutes and rules under its jurisdiction, or by which the Department can determine that the Petitioner is substantially affected.
