    NOTICE IS HEREBY GIVEN that the Florida Public Employees Relations Commission (Commission) has received the petition for declaratory statement from Florida Education Association, Case No. DS-2017-002. The petition seeks the agencys opinion as to the applicability of Sections 447.201, .301, .309 and .401, Florida Statutes (2016) as they apply to the petitioner.

    The Petitioner asks the Commission to answer the following questions: Question 1: When requested for collective bargaining, grievance processing or other legitimate union administration purpose, what right does a public employee organization have to obtain student directory information, as defined in 34 CFR 99.3, from a district school board in Florida? Question 2: When requested for collective bargaining, grievance processing or other legitimate union administration purpose, what right does a public employee organization have to obtain student directory information, as defined in 34 CFR 99.3, from a state university or college where the union represents the students in question as members of a graduate assistant bargaining unit? Except for good cause shown, motions to intervene by persons whose substantial interests may be affected by the disposition of the declaratory statement must be filed within twenty-one (21) days after publication of the notice in the Florida Administrative Register. Persons whose substantial interests may be affected may file a petition for an administrative hearing.
