NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from William J. Cochran, Unit Owner, In Re: Madeira Beach Yacht Club Condominium Association, Inc., Docket No. 2016004741, filed on January 29, 2016. The petition seeks the agency's opinion as to the applicability of Section 718.110(1)(b), Florida Statutes, as it applies to the petitioner.

Whether the Association’s November 18, 2015 amendment of the rules and regulations to adopt “Rule K. Use Restrictions” is an illegal and invalid amendment pursuant to section 718.110(1)(b), Florida Statutes.
