NOTICE IS HEREBY GIVEN that the Division of Florida Condominiums, Timeshares, and Mobile Homes, Department of Business and Professional Regulation, State of Florida, has received the petition for declaratory statement from Elena Soutullo, In Re: Kensington Condominium Association of Hialeah, Inc., Docket No. 2013051479, filed on February 18, 2014.The petition seeks the agency's opinion as to the applicability of Section 718.112(2)(i), Florida Statutes, as it applies to the petitioner.

Whether Kensington Condominium Association of Hialeah, Inc., had the legal authority under Section 718.112(2)(i), Florida Statutes, to demand screening fees, regardless of the fact that such owner had already been successfully approved.
