The Board of Opticianry hereby gives notice that it has received a petition for Declaratory Statement, filed on February 3, 2009, by Anthony D. Record, a Florida licensed optician. The Petitioner seeks the Board’s guidance regarding several issues relating to Section 484.002(9), Florida Statutes. Specifically, the Petitioner requests guidance on various optical dispensing scenarios of a hypothetical written prescription including the substitution of a less expensive progressive brand for a premium progressive brand.

The Board will address this Petition at its next meeting.
