NOTICE IS HEREBY GIVEN that the Board of Nursing has issued an order disposing of the petition for declaratory statement filed by Lisa Bergeron on April 16, 2013. The following is a summary of the agency’s disposition of the petition:

The Notice of Petition for Declaratory Statement was published in Volume 39, No. 88, of the May 6, 2013 Florida Administrative Register. Petitioner asks the Board’s opinion as to the applicability of Sections 464.018(1) and 456.072(1), F.S., and subsection 64B9-8.005(13), F.A.C., regarding whether ventriculostomy flushing is within the scope of practice for a registered nurse The Board’s Order, filed on February 20, 2014, states that the petition requests a statement of general applicability that is not appropriate for resolution by the issuance of a declaratory statement. The Board of Nursing does not issue opinions concerning the validity of facility protocols.
