    NOTICE IS HEREBY GIVEN that Board of Massage Therapy has issued an order disposing of the petition for declaratory statement filed by Jennifer E. Kane, on November 13, 2018. The following is a summary of the agency's disposition of the petition: The Notice of Petition for Declaratory Statement was published in Volume 44, No. 223, of the November 15, 2018, Florida Administrative Register. The Board reviewed the Petition as its telephonic conference call meeting held on December 12, 2018. The Board’s Order, filed on March 14, 2019, found that the petition was not in substantial compliance with the provisions of Section 120.565, F.S., and Chapter 28-105, F.A.C., specifically noting that: Petitioner lack standing and has not achieved the purpose of the underlying statute as has not sufficiently demonstrated that the proposed practice fits within the scope of practice as it relates to the definition of “massage” pursuant to the practice act for the profession, Chapter 480, F.S. The Petition for Declaratory Statement is denied.
